【摘要】：民以食為天、食以安為先,如何撐起兒童食品安全這片天,保護(hù)國家的未來和希望,成為社會熾熱關(guān)注點(diǎn)。兒童食品安全問題一度成為“兩會”的熱議焦點(diǎn)和社會熱點(diǎn)問題。隨著二胎政策實(shí)施,對監(jiān)管的挑戰(zhàn)隨之而來。近些年,頻發(fā)的兒童食品安全事故引發(fā)民眾對政府監(jiān)管的信任危機(jī),同時(shí)使得人們對兒童食品安全的呼聲越發(fā)強(qiáng)烈。2015年雖對《食品安全法》進(jìn)行了進(jìn)步性修改,但針對兒童食品安全監(jiān)管問題并未有實(shí)際性突破。我國兒童食品安全監(jiān)管體系欠健全,相關(guān)法律制度及標(biāo)準(zhǔn)滯后,監(jiān)管職責(zé)設(shè)置不清,責(zé)任追究機(jī)制不完善等因素,使我國兒童食品安全監(jiān)管仍處于任重而道遠(yuǎn)境地。因此,完善兒童食品安全監(jiān)管法律制度已成為一項(xiàng)重要研究課題。由此,文章以兒童食品安全監(jiān)管法律制度中的一些現(xiàn)實(shí)問題作為研究對象,引入現(xiàn)實(shí)中“假冒進(jìn)口奶粉案例”“三聚氰胺奶粉事件”,指出我國兒童食品安全事故頻發(fā)和監(jiān)管法律制度中的缺陷存在密切聯(lián)系。再從兒童食品安全監(jiān)管相關(guān)標(biāo)準(zhǔn)、主體、法律等實(shí)施現(xiàn)狀入手展開研究,查閱其他發(fā)達(dá)國家在兒童食品安全標(biāo)準(zhǔn)、法律等規(guī)定。較之分析中外在兒童食品安全監(jiān)管制度的差異和啟示,指出監(jiān)管制度在實(shí)施過程現(xiàn)狀之原因。最后從兒童食品安全監(jiān)管相關(guān)法律、兒童食品安全標(biāo)準(zhǔn)、兒童食品監(jiān)管機(jī)構(gòu)、兒童食品安全責(zé)任追究、兒童食品市場準(zhǔn)入等方面提出完善我國兒童食品安全監(jiān)管法律制度的構(gòu)想。
[Abstract]:How to support children's food safety and protect the future and hope of the country has become a hot social concern. The issue of children's food safety once became the focus of the two sessions and the hot issue of the society. With the implementation of the two-child policy, regulatory challenges followed. In recent years, frequent food safety accidents for children have triggered a crisis of public trust in government supervision, while increasing calls for food safety for children. Although the Food Safety Act was amended progressively in 2015, However, there is no practical breakthrough in the supervision of children's food safety. In China, children food safety supervision system is not perfect, related legal system and standards lag behind, regulatory responsibilities are not clear, accountability mechanism is not perfect, and so on, which makes children food safety supervision in our country still have a long way to go. Therefore, the improvement of children's food safety regulatory legal system has become an important research topic. Therefore, the article takes some practical problems in the legal system of children's food safety supervision as the research object, and introduces the case of "fake imported milk powder" and "melamine milk powder incident" in reality. It is pointed out that the frequent occurrence of food safety accidents of children in China is closely related to the defects in the legal system of supervision. Then from the children food safety supervision related standard, the main body, the law and so on implementation present situation starts the research, consults other developed countries in the child food safety standard, the law and so on stipulation. Compared with the differences and revelations between China and foreign countries in the supervision system of children's food safety, this paper points out the reasons for the present situation of the supervision system in the process of implementation. Finally, from the relevant laws of children's food safety supervision, children's food safety standards, children's food regulatory agencies, children's food safety accountability, Children's food market access and other aspects proposed to improve our children's food safety regulatory legal system.
