【摘要】：日本針對教科書法定許可補償金標準做出比較完善的規(guī)定,其根據(jù)使用學(xué)校階段、作品種類、刊載作品篇幅、教科書發(fā)行部數(shù)進行區(qū)分規(guī)定,每年定期調(diào)整,形成一個動態(tài)標準。這既契合各方利益需求,又與經(jīng)濟發(fā)展的客觀規(guī)律相適應(yīng)。我國應(yīng)借鑒日本在該方面的靈活做法,以充分保障著作權(quán)人的合法利益。
[Abstract]:Japan has made relatively perfect regulations on the standard of compensation for legal permission for textbooks. It is based on the school stage of use, the types of works, the length of published works, the number of distribution departments of textbooks, and is adjusted regularly every year. Form a dynamic standard. This is not only in line with the interests of all parties, but also with the objective laws of economic development. China should draw lessons from Japan's flexible practices in order to fully protect the legitimate interests of copyright owners.
