政府業(yè)務(wù)委外的法律規(guī)制研究

【摘要】:政府業(yè)務(wù)委外中,因?yàn)椴捎眯姓跈?quán)、行政委托、契約等不同的委外方式,使得政府業(yè)務(wù)委外呈現(xiàn)出多重法律關(guān)系。另外,委外過程中極易出現(xiàn)損害公益、模糊責(zé)任、權(quán)力濫用、私人壟斷等風(fēng)險(xiǎn)。因此有必要對(duì)政府業(yè)務(wù)委外從立法、規(guī)制模式、監(jiān)管制度、程序規(guī)則、救濟(jì)路徑等方面進(jìn)行法律規(guī)制,以推動(dòng)政府業(yè)務(wù)委外的發(fā)展,防范與控制其可能產(chǎn)生的風(fēng)險(xiǎn)。 第一章是政府業(yè)務(wù)委外的概述。首先理清了政府業(yè)務(wù)委外的含義與本質(zhì),同時(shí)對(duì)政府業(yè)務(wù)委外與民營(yíng)化、政府業(yè)務(wù)委外與公私合作制的關(guān)系進(jìn)行闡釋。其次分析政府業(yè)務(wù)委外的方式,結(jié)合我國(guó)行政法學(xué)理論與法律實(shí)踐,對(duì)行政授權(quán)、行政委托、契約、純粹私人主體的四種方式進(jìn)行具體分析,并介紹了三種具體政府業(yè)務(wù)委外的類型。最后政府業(yè)務(wù)委外的法律關(guān)系,具體的分析了委任主體與受委任者、受委任者與其相對(duì)人、委任主體與相對(duì)人的三方法律關(guān)系,為后文的委外救濟(jì)提供了依據(jù)。 第二章政府業(yè)務(wù)委外規(guī)制的依據(jù)。從委外規(guī)制的現(xiàn)實(shí)依據(jù)與法理依據(jù)進(jìn)行了分析。 第三章政府業(yè)務(wù)委外規(guī)制的立法,F(xiàn)有行政法律依據(jù)存在層次較低、內(nèi)容簡(jiǎn)單的問題,需要完善委外相關(guān)的法律制度。 第四章政府業(yè)務(wù)委外規(guī)制的模式。主張建立公私法共同規(guī)制的模式。 第五章政府業(yè)務(wù)委外規(guī)制的具體制度。第一節(jié)是政府業(yè)務(wù)委外的監(jiān)管制度。政府業(yè)務(wù)委外中,政府的角色更多地轉(zhuǎn)向?yàn)闆Q策者、監(jiān)督者、擔(dān)保者的身份,在發(fā)揮政府監(jiān)管的同時(shí),還需要充分發(fā)揮第三方監(jiān)管與自我監(jiān)管的作用,構(gòu)建以政府監(jiān)管為主,涵蓋第三方監(jiān)管、自我規(guī)制的監(jiān)管體系。第二節(jié)政府業(yè)務(wù)委外的程序制度。從信息公開、聽證、說明理由三方面進(jìn)行程序制度的完善。第三節(jié)政府業(yè)務(wù)委外的法律救濟(jì),主張從委外關(guān)系的不同性質(zhì)出發(fā),構(gòu)建涵蓋行政復(fù)議、行政訴訟、國(guó)家賠償、民事訴訟、仲裁救濟(jì)的全方位、立體式的救濟(jì)體系。
[Abstract]:The government business committee, because of the use of administrative authorization, administrative entrustment, contract and other different methods, makes the government business committee outside the multiple legal relations. In addition, it is very easy to harm public welfare, fuzzy responsibility, abuse of power, private monopoly and other risks in the process of outsourcing. Therefore, it is necessary to take legislation and regulation mode to the government business committee. Regulatory system, procedural rules, relief path and other aspects of legal regulation, in order to promote the development of government business outsourcing, to prevent and control its possible risks.
The first chapter is the outline of the government business committee. First, it clarifies the meaning and essence of the government business committee, and explains the relationship between the Government Business Committee and the privatization, the relationship between the Government Business Committee and the public and private cooperative system. Secondly, it analyzes the way of the government business Committee, and combines the theory of administrative law and the practice of law in China, and the administrative authorization and administration. The four ways of entrustment, contract and pure private subject are analyzed, and the types of three specific government business committees are introduced. Finally, the legal relationship outside the government business committee is made, and the legal relationship between the appointed subject and the appointed person, the appointed person and the relative person, the three party of the appointed owner and the relative person is analyzed. It provides a basis for it.
The second chapter is the basis for the regulation of government business, and analyzes the practical basis and legal basis of the outsourcing regulation.
The third chapter is about the legislation of government business outsourcing regulation. The existing administrative law has a low level and simple content. It needs to perfect the related legal system.
The fourth chapter is about the mode of government business outsourcing regulation, advocating the establishment of a common mode of public private law regulation.
The fifth chapter is the specific system of the government business commission regulation. The first section is the regulatory system outside the government business committee. In the government business committee, the role of the government is more turning to the identity of the decision-makers, supervisors and guarantor. While playing government supervision, the role of the third party supervision and self-regulation should be fully played, and the government supervision is built. The management system covers the third party supervision and self regulation. The second section of the procedural system outside the government business committee. From the three aspects of information disclosure, hearing and explanation, the third section of the legal remedies outside the government business committee advocates the construction of administrative reconsideration and administrative litigation from the different nature of the external relations. State compensation, civil litigation, arbitration relief in all directions, three-dimensional relief system.
