我國就業(yè)機(jī)會(huì)平等法律制度的完善

【摘要】:實(shí)行民生法治是我國建設(shè)法治國家和法治社會(huì)的內(nèi)在要求,也是社會(huì)主義制度優(yōu)越性的體現(xiàn)。就業(yè)是民生法治的一個(gè)重要領(lǐng)域,就業(yè)關(guān)乎勞動(dòng)者的合法勞動(dòng)權(quán)益和個(gè)人收入,有助于實(shí)現(xiàn)共同富裕。同時(shí),平等就業(yè)權(quán)是國家法律賦予公民的權(quán)利,保障人權(quán)要求保障公民的平等就業(yè)權(quán)。然而,在我國當(dāng)前社會(huì)體系的就業(yè)過程中,許多勞動(dòng)者和潛在勞動(dòng)者在就業(yè)過程中沒有得到平等的就業(yè)機(jī)會(huì),用人單位人為地設(shè)置一些非必要限制條件令勞動(dòng)者失去平等的就業(yè)機(jī)會(huì)。并且伴隨著社會(huì)的轉(zhuǎn)型,就業(yè)機(jī)會(huì)不平等現(xiàn)象愈演愈烈,各種就業(yè)歧視仍舊層出不窮,由此產(chǎn)生的社會(huì)不安因素在許多領(lǐng)域已嶄露頭角。與此同時(shí),我國在保護(hù)就業(yè)機(jī)會(huì)平等的法律制度中,立法、司法及執(zhí)法方面都存在不完善的地方,必須予以解決;诖爽F(xiàn)狀,本文在社會(huì)調(diào)研基礎(chǔ)上展開對就業(yè)過程中機(jī)會(huì)平等問題法律保護(hù)的探討和研究。采取舉例分析法、比較分析法、文獻(xiàn)分析法、社會(huì)調(diào)研法等方法,對我國當(dāng)前存在的就業(yè)機(jī)會(huì)不平等系列問題進(jìn)行分析并有針對性地提出解決就業(yè)機(jī)會(huì)不平等、保障勞動(dòng)者平等就業(yè)權(quán)的法律措施。文章分三章。第一章主要介紹機(jī)會(huì)平等的內(nèi)涵及界定了就業(yè)機(jī)會(huì)平等的概念和就業(yè)機(jī)會(huì)平等理念的歷史發(fā)展,闡釋了保障就業(yè)機(jī)會(huì)平等的價(jià)值。第二章主要介紹我國就業(yè)機(jī)會(huì)平等發(fā)展過程中出現(xiàn)的問題,采取實(shí)證方法進(jìn)行分析,主要提出了保護(hù)就業(yè)機(jī)會(huì)平等的立法不完善、司法制度不完善、政府和社會(huì)組織的效用未充分發(fā)揮的法律困境。第三章主要介紹具體的關(guān)于機(jī)會(huì)平等在就業(yè)領(lǐng)域的法律保護(hù)措施。具體提出完善對用人單位法律責(zé)任的設(shè)置、規(guī)制用工自主權(quán)、合理分配用人單位與勞動(dòng)者雙方的舉證責(zé)任、完善公益訴訟制度、加強(qiáng)政府部門的執(zhí)法監(jiān)督及充分發(fā)揮社會(huì)組織的作用等法律保護(hù)對策,以期能夠?qū)Ξ?dāng)前就業(yè)領(lǐng)域的就業(yè)機(jī)會(huì)不平等的行為有所遏制。
[Abstract]:The implementation of the people's livelihood rule of law is the inherent requirement of building a country ruled by law and a society ruled by law, and the embodiment of the superiority of the socialist system. Employment is an important field of people's livelihood, employment is related to the legitimate labor rights and interests of workers and personal income, helping to achieve common prosperity. At the same time, the equal right to employment is the right given by the national law, and the protection of human rights requires the protection of equal employment rights of citizens. However, in the process of employment in China's current social system, many workers and potential workers have not received equal employment opportunities in the process of employment. Employers artificially set some non-necessary restrictions to make workers lose equal employment opportunities. Along with the transformation of society, the inequality of employment opportunities is becoming more and more serious, and all kinds of employment discrimination still emerge in endlessly. The social uneasiness has emerged in many fields. At the same time, there are some imperfections in legislation, judicature and law enforcement in the legal system of equal employment opportunity in our country, which must be solved. Based on the present situation, this paper explores and studies the legal protection of equal opportunities in the process of employment on the basis of social research. By using the methods of example analysis, comparative analysis, literature analysis, social investigation and so on, this paper analyzes the series of problems of employment opportunity inequality existing in our country and puts forward to solve the employment opportunity inequality. Legal measures to protect the equal right of workers to employment. The article is divided into three chapters. The first chapter mainly introduces the connotation of equality of opportunity, defines the concept of equal opportunity in employment and the historical development of the concept of equal opportunity in employment, and explains the value of ensuring equal opportunity in employment. The second chapter mainly introduces the problems in the process of the equal development of employment opportunity in our country, adopts the empirical method to carry on the analysis, mainly proposed that the legislation which protects the employment opportunity equality is not perfect, the judicial system is not perfect. The legal dilemma that the effectiveness of government and social organizations is not fully developed. The third chapter mainly introduces the specific legal protection measures of equal opportunities in the field of employment. To improve the legal liability of employers, regulate the autonomy of employment, reasonably distribute the burden of proof between employers and workers, and perfect the public interest litigation system. Strengthen the law enforcement supervision of government departments and give full play to the role of social organizations and other legal protection measures in order to curb the current employment field of unequal employment opportunities behavior.
