【摘要】：作為農村土地物權非常重要的一類,農村集體的"四荒"土地承包經營權的設立的制度是否健全,關乎了集體荒地的開發(fā)的經濟和生態(tài)實效,也關乎了相關權利人的切身利益。本文為了分析集體荒地承包權利在締約程序中存在的漏洞,本文先后從界定此種權利的含義、特點和設立方式出發(fā),并對該權登記的確權效力問題進行了探討,最后提出了若干完善建議。第一部分首先界定了集體"四荒"土地,對集體"四荒"土地的承包經營權的客體進行了分析界定;其次通過比對一般的土地承包經營權,簡述了"四荒"土地承包經營權的概念和特征;最后簡單梳理我國現(xiàn)行法中所規(guī)定的"四荒"土地承包權的設立程序。第二部分研究了"四荒"土地承包經營權合同締結的一些問題,如對該荒地承包經營權三種設立方式分別進行了描述,并分析出了三種設立方式的特點和法律漏洞;此外,本文還研究了與締結合同有關的民主程序和政府審批問題,同樣分析了這兩個程序在法律和運作中出現(xiàn)的問題。第三部分主要研究了 "四荒"土地承包經營權的登記效力的相關問題。對現(xiàn)行法中有關該集體荒地承包經營權的條文進行了研究,分析了它們之間的沖突。第四部分主要是針對第二部分合同締結相關問題和第三部分登記效力相關問題提出了自己的若干建議。
[Abstract]:As a very important kind of rural land real right, whether the establishment system of "four wasteland" land contractual management right in rural collective is sound or not is related to the economic and ecological effect of collective wasteland development, and also to the vital interests of relevant right holders. In order to analyze the loopholes of collective barren land contracting right in the contracting procedure, this paper begins with the definition of this right, its characteristics and the way of its establishment, and probes into the validity of the right registration. Finally, some suggestions are put forward. The first part defines the collective "four wasteland" land, analyzes and defines the object of the collective "four famine" land contractual management right, and then compares the general land contract management right. This paper briefly introduces the concept and characteristics of the land contract management right of "four wasteland", and finally briefly combs the establishment procedure of the "four famine" land contract right stipulated in the current law of our country. In the second part, the author studies some problems in concluding the contract of land contractual management right of "four wasteland", such as describing the three ways of establishing the contractual management right of the wasteland, and analyzing the characteristics and legal loopholes of the three ways of establishing the land contract management right. This paper also studies the democratic procedure and the governmental examination and approval related to the conclusion of contracts, and also analyzes the problems in the law and operation of these two procedures. The third part mainly studies the registration effectiveness of the four wasteland land contract management right. This paper studies the provisions of the current law concerning the contractual management right of the collective wasteland, and analyzes the conflicts between them. The fourth part mainly puts forward some suggestions on the problems related to the conclusion of contract in the second part and the registration effect in the third part.
