【摘要】：警察職責與警察義務(wù)是警察法學上的兩個基本概念,二者既有密切聯(lián)系,又有明顯區(qū)別。警察義務(wù)包括警察組織的義務(wù)和警察人員的義務(wù),警察職責屬于警察組織的義務(wù)。我國《人民警察法》沒有區(qū)分警察組織的義務(wù)與警察人員的義務(wù),實踐中經(jīng)常發(fā)生警察角色沖突問題。構(gòu)建和諧警民關(guān)系,需要適用警察公共原則和緊急性原則來區(qū)分警察組織的義務(wù)與警察人員的義務(wù)。為此,要修改《人民警察法》的相關(guān)內(nèi)容,刪除該法第21條的規(guī)定,明確規(guī)定警察的服務(wù)職責包括危難救助、保管遺失物和無人認領(lǐng)的財物、在緊急情況下輔助解決民事爭執(zhí)等。
[Abstract]:Police duty and police duty are two basic concepts in police jurisprudence, which are closely related and distinct. The duty of the police includes the duty of the police organization and the duty of the police personnel, and the duty of the police is the duty of the police organization. The people's Police Law of our country does not distinguish between the duty of police organization and the duty of police personnel, and the conflict of police role often occurs in practice. In order to build a harmonious relationship between the police and the public, it is necessary to apply the principles of public police and urgency to distinguish the obligations of the police organization from the duties of the police personnel. To this end, it is necessary to amend the relevant contents of the people's Police Law, to delete the provisions of Article 21 of the Law, and to specify that the service duties of the police include rescue in distress, custody of lost belongings and unclaimed property, Assist in resolving civil disputes in an emergency, etc.
