【摘要】：隨著社會和經(jīng)濟(jì)的快速發(fā)展,文化開始作為一種商品大量的涌入了市場,文化市場和文化產(chǎn)業(yè)相繼出現(xiàn)和形成。由于文化市場體制機(jī)制的不健全、文化市場發(fā)展的規(guī)律與行政管理之間的矛盾,制約著文化市場的繁榮發(fā)展,這就使得我國的相關(guān)文化管理部門要不斷地深入實踐,轉(zhuǎn)變文化市場的管理職能。2004年起,我國政府開始對文化市場的行政執(zhí)法模式進(jìn)行改革,2005年從化市完成了文化市場綜合執(zhí)法改革工作。經(jīng)過改革,規(guī)范了行政執(zhí)法主體的行為,健全了法制法規(guī),文化市場秩序明顯改善,但是受制于文化市場的局限性和執(zhí)法模式自發(fā)性的影響,從化市文化市場執(zhí)法仍存在著執(zhí)法主體不具備主體資格、行政審批與行政執(zhí)法未分離等問題,制約了從化市文化市場的健康有序發(fā)展。本文以從化市文化市場綜合行政執(zhí)法模式作為研究對象,通過參考國內(nèi)外相關(guān)學(xué)者對文化執(zhí)法模式方面問題的研究,以行政執(zhí)法理論、文化市場執(zhí)法模式、政府職能理論作為論文研究的理論依據(jù)。通過開展問卷調(diào)查和個案分析的方法,收集大量的數(shù)據(jù)和信息進(jìn)行對比、分析,深入研究從化市文化市場綜合行政執(zhí)法的現(xiàn)狀,對從化市文化市場綜合行政執(zhí)法模式存在的主要問題及原因進(jìn)行了探討。在借鑒國內(nèi)外先進(jìn)的執(zhí)法管理經(jīng)驗和行政執(zhí)法模式的基礎(chǔ)上,對從化市文化市場綜合行政執(zhí)法模式提出設(shè)想和構(gòu)思,即構(gòu)建從化市文化市場綜合行政大執(zhí)法模式,獨立行使文化市場相關(guān)的監(jiān)管和行政處罰權(quán),對該模式的機(jī)構(gòu)設(shè)置進(jìn)行規(guī)劃,探討了該模式的優(yōu)越性和工作機(jī)制,以此推動從化市文化市場綜合行政執(zhí)法工作法制化、規(guī)范化、有序化發(fā)展。
[Abstract]:With the rapid development of society and economy, culture began to flow into the market as a commodity, and culture market and culture industry appeared and formed one after another. Because of the imperfect system and mechanism of the cultural market, the contradiction between the law of the development of the cultural market and the administration, it restricts the prosperous development of the cultural market. In 2004, our government began to reform the administrative law enforcement mode of cultural market. In 2005, Conghua City completed the comprehensive law enforcement reform of cultural market. After the reform, the behavior of the subject of administrative law enforcement has been standardized, the legal system and regulations have been improved, and the order of the cultural market has obviously improved, but it is subject to the limitations of the cultural market and the spontaneous influence of the law enforcement model. There are still some problems in the law enforcement of cultural market in Conghua, such as the lack of subject qualification and the lack of separation between administrative examination and approval and administrative law enforcement, which restrict the healthy and orderly development of cultural market in Conghua. This paper takes the comprehensive administrative law enforcement model of cultural market in Conghua as the research object, by referring to the domestic and foreign scholars' research on the cultural law enforcement model, with the administrative law enforcement theory, the cultural market law enforcement model, The theory of government function is the theoretical basis of the thesis. Through the methods of questionnaire investigation and case analysis, collecting a large amount of data and information for comparison and analysis, and deeply studying the current situation of comprehensive administrative law enforcement in the cultural market of Conghua, This paper probes into the main problems and causes of the comprehensive administrative law enforcement mode in the cultural market of Conghua. On the basis of drawing lessons from the domestic and foreign advanced law enforcement management experience and administrative law enforcement mode, this paper puts forward some ideas on the comprehensive administrative law enforcement model of cultural market in Conghua, that is, to construct the comprehensive administrative law enforcement model of cultural market in Conghua. In order to promote the legalization and standardization of the comprehensive administrative law enforcement in the cultural market of Conghua, the author independently exercises the supervision and administrative punishment power of the cultural market, plans the institutional setting of the model, and probes into the superiority and working mechanism of the model, so as to promote the legalization and standardization of the comprehensive administrative law enforcement work in the cultural market of Conghua. Orderly development.
