【摘要】:近年來,隨著我國市場經(jīng)濟的繁榮,第三產(chǎn)業(yè)不斷擴大,勞動用工形式也發(fā)展為多種多樣,用人單位對工作時間的需求表現(xiàn)出越來越靈活的趨向。一方面,很多用人單位要求勞動者在正常工作時間之外,著手與工作有關的預備工作,或者要求勞動者處于等待的狀態(tài),以確保勞動者在接到用人單位的通知時能及時完成其交付的工作;另一方面,勞動者權利保護意識不斷增強,要求維護自己的休息權和勞動報酬權等合法權益。因待命時間引發(fā)的勞動糾紛案件越來越多,甚至有愈演愈烈之勢。究其原因,國家立法層面上相關規(guī)定的缺失首當其沖,地方性規(guī)定的各不相同也是爭議之源。這不僅不利于勞動者正當權益的保護,而且損害了司法權威,更不利于和諧勞動關系的建設。因此,有必要對待命時間法律問題進行系統(tǒng)研究,深入剖析待命時間的性質,為混亂的實務判決提供理論借鑒,也為我國勞動法的完善提供理論支撐。本文第一部分對待命時間的基本理論進行了介紹,包括待命時間的概念、特征以及分類。在綜合分析這些基本理論的基礎之上,筆者給出了自己對待命時間的認識,即待命時間是指勞動者處于等待狀態(tài),但遇到特殊情形出現(xiàn)時需要及時完成用人單位交付的工作任務的一段時間。第二部分對國內(nèi)外關于待命時間認定的學說和規(guī)定進行梳理評價,并結合工作時間的認定標準,得出勞動者所在的場所和勞動者的受控性是影響待命時間認定為工作時間的主要因素。第三部分討論了待命時間內(nèi)勞動者權益保障問題,包括勞動者工資支付和工傷認定問題。筆者根據(jù)待命時間內(nèi)勞動者受控程度的差別,分類討論高度待命時間、中度待命時間和低度待命時間工資支付的標準。關于待命時間工傷認定問題,筆者結合傳統(tǒng)工傷認定標準,認為待命時間內(nèi)的工傷認定主要取決于工作原因和工作時間,工作場所不應作為認定標準。本文最后一部分討論了待命時間內(nèi)勞動者義務約束問題,分析了勞動者除了要遵守勞動法上規(guī)定的基本義務,還要遵守用人單位規(guī)定的特殊要求。為了確保待命時間內(nèi)的勞動者切實履行義務,提出了具體的建議。待命時間相關法律問題在如今的社會與我們每個人都休戚相關,因此妥善處理這些問題意義重大,不僅可以平衡用人單位和勞動者在勞動關系中的利益,避免由此引發(fā)的勞動爭議,還為構建良好的勞動關系提供保障。
[Abstract]:In recent years, with the prosperity of the market economy in our country, the tertiary industry has been expanding, and the forms of labor and employment have also developed into various forms. The demand of employers for working hours has shown a more and more flexible trend. On the one hand, many employers require workers to start preparatory work related to work outside normal working hours, or to require workers to be in a state of waiting. On the other hand, the consciousness of protection of workers' rights is constantly strengthened, and the legitimate rights and interests such as the right to rest and the right to remuneration are required to be safeguarded. Due to standby time caused by labor disputes more and more cases, or even intensified. The reason is that the lack of relevant regulations on the national legislative level is the first, and the differences of local regulations are also the source of controversy. This is not only harmful to the protection of the legitimate rights and interests of laborers, but also harmful to the judicial authority and the construction of harmonious labor relations. Therefore, it is necessary to make a systematic study on the legal issue of standby time, analyze the nature of standby time in depth, provide theoretical reference for the chaotic practical judgment, and provide theoretical support for the perfection of China's labor law. The first part of this paper introduces the basic theory of standby time, including the concept, characteristics and classification of standby time. On the basis of comprehensive analysis of these basic theories, the author gives his own understanding of standby time, that is, standby time means that the worker is in a state of waiting. But meet special circumstance to need to complete the work task that unit of choose and employ persons delivers a period of time in time. The second part combs and evaluates the domestic and foreign theories and regulations on standby time identification, and combines with the working time identification standard, It is concluded that the place where workers are located and their controllability are the main factors that affect the working hours. The third part discusses the protection of workers' rights and interests during standby time, including the payment of workers' wages and the identification of industrial injuries. According to the differences of workers' controlled degree in standby time, the author discusses the criteria of high standby time, medium standby time and low standby time wage payment. Regarding the problem of the identification of work-related injuries during standby time, the author considers that the determination of work-related injuries during standby hours mainly depends on the working reasons and working hours, and the workplace should not be regarded as the standard of identification. In the last part of this paper, we discuss the constraint of laborer's obligation in standby time, and analyze that the laborer should abide by the special requirements of the employer in addition to the basic obligation stipulated in the labor law. In order to ensure that workers on-call time to fulfil their obligations, specific recommendations are made. Legal issues related to standby time are closely related to each and every one of us in today's society, so it is important to deal with them properly, not only to balance the interests of employers and workers in labour relations, To avoid the labor disputes caused by this, but also to provide protection for the construction of good labor relations.
