【摘要】：為優(yōu)化能源結(jié)構(gòu),改善環(huán)境污染現(xiàn)象,我國(guó)大力發(fā)展核工業(yè),建設(shè)涉核項(xiàng)目。由于涉核項(xiàng)目具有潛在的放射性與危險(xiǎn)性,其選址與建設(shè)總會(huì)引起周邊居民的不滿(mǎn)與恐慌,從而產(chǎn)生鄰避現(xiàn)象。本文從連云港市民聯(lián)合抵制乏燃料后處理廠的鄰避事件出發(fā),以法律角度挖掘此類(lèi)公共事件發(fā)生的原因,即,未給予"鄰避居民"充分的知情權(quán)與話(huà)語(yǔ)權(quán),缺乏宣傳教育,未建立"鄰避居民"補(bǔ)償機(jī)制以及公眾求償機(jī)制不夠完善。因此,本文結(jié)合現(xiàn)行立法以及即將出臺(tái)的《核安全法》(草案),提出防控此類(lèi)公共事件的法律手段,建議政府相關(guān)部門(mén)以及涉核項(xiàng)目營(yíng)運(yùn)者要堅(jiān)持涉核項(xiàng)目選址與建設(shè)決策的科學(xué)化和民主化;建立核設(shè)施周邊居民經(jīng)濟(jì)補(bǔ)償機(jī)制;利用我國(guó)現(xiàn)有核損害責(zé)任保險(xiǎn)及財(cái)務(wù)保證制度,建立核風(fēng)險(xiǎn)轉(zhuǎn)移機(jī)制,從而在降低涉核項(xiàng)目產(chǎn)生放射性危害可能性的同時(shí),減弱周邊民眾容易產(chǎn)生的焦慮抵觸情緒。
[Abstract]:In order to optimize the energy structure and improve the environmental pollution, our country vigorously develops the nuclear industry and builds the nuclear-related projects.Because of the potential radioactivity and danger, the site selection and construction always cause discontent and panic among the surrounding residents, thus causing the phenomenon of neighborhood avoidance.From the view of the residents of Lianyungang boycotting the neighboring events of the spent fuel reprocessing plant, this paper explores the causes of this kind of public events from the legal point of view, that is, the lack of adequate right to know and the right to speak, and the lack of publicity and education.The compensation mechanism and the public claim mechanism are not perfect.Therefore, combined with the existing legislation and the upcoming Nuclear Safety Law (draft), this paper proposes legal means to prevent and control such public incidents.It is suggested that relevant government departments and operators of nuclear-related projects should adhere to the scientific and democratic decision-making on siting and construction of nuclear-related projects; establish economic compensation mechanisms for residents around nuclear facilities; and make use of the existing nuclear damage liability insurance and financial assurance system in China.The mechanism of nuclear risk transfer is established to reduce the possibility of radioactive damage caused by nuclear-related projects and to reduce the anxiety and resistance easily generated by the people around them at the same time.
