【摘要】：自我規(guī)制與環(huán)境法實施有著非常密切的關系。環(huán)境規(guī)制結構演進和制度競爭優(yōu)勢構成環(huán)境法中自我規(guī)制的正當性基礎。在類型化基礎上逐漸發(fā)展出企業(yè)(行業(yè))環(huán)境標準、全過程自我管理和基于合同的合作規(guī)制等多元形態(tài)的自我規(guī)制方式。實體規(guī)制和程序規(guī)制結合、直接規(guī)制和間接規(guī)制呼應、多種責任形式聚合構成環(huán)境法中自我規(guī)制的主要特征。在準確把握自我規(guī)制制度價值、功能和自治定位基礎上,圍繞結構完善和內容協(xié)同構建自我規(guī)制制度體系,結合范式轉換和功能升級調整自我規(guī)制制度運行機制,按照激勵與約束并重原則推進自我規(guī)制的有效實施。一個多元、高效、均衡和互補的環(huán)境規(guī)制體系有利于推進環(huán)境法的實施。
[Abstract]:Self-regulation has a very close relationship with the implementation of environmental law.The evolution of environmental regulation structure and institutional competitive advantage constitute the legitimacy basis of self-regulation in environmental law.On the basis of typology, the enterprise (industry) environmental standard, the whole process of self-management and the cooperative regulation based on contract are gradually developed into multi-forms of self-regulation.The combination of substantive regulation and procedural regulation, direct regulation and indirect regulation, and the aggregation of various forms of responsibility constitute the main characteristics of self-regulation in environmental law.On the basis of accurately grasping the value, function and autonomy of self-regulation system, the system of self-regulation system is built around the perfection of structure and the content of self-regulation system, and the operational mechanism of self-regulation system is adjusted according to the transformation of paradigm and the upgrading of function.To promote the effective implementation of self-regulation according to the principle of equal emphasis on incentives and constraints.A pluralistic, efficient, balanced and complementary environmental regulation system is conducive to the implementation of environmental law.
