【摘要】：從三鹿奶粉事件的曝光開始,食品安全問題就已備受關(guān)注,雖然食品安全問題經(jīng)過政府的有效管理和媒體的頻繁曝光有所收斂,但是并沒有從根本上杜絕,蘇丹紅雞蛋、毒豆芽等問題食品仍然在侵蝕消費者的安全。本文研究意義不是如何遏制食品安全問題的再發(fā)生,而是在食品問題發(fā)生之后,如何更好地處理其產(chǎn)生的惡劣影響,維護經(jīng)濟與社會的穩(wěn)定。具體來說,就是通過在食品領(lǐng)域設(shè)置強制類保險制度的方法,以此來解決實踐中受害人得不到實際賠付的問題,以及解決因高額賠償導(dǎo)致企業(yè)資不抵債的困境,并將政府從高額的賠償問題中解脫出來,使其可以更有精力解決食品安全問題。本文是對食品安全強制保險制度的研究,在結(jié)構(gòu)上分為五個部分,包括:緒論、食品安全責(zé)任強制保險制度的相關(guān)概述、域外食品安全責(zé)任強制保險制度相關(guān)理論的概述、從宏觀和微觀的兩個完成對該制度的構(gòu)建以及文章的結(jié)論。第一部分緒論。主要介紹文章研究背景、研究方法、研究價值,以及國內(nèi)外相關(guān)學(xué)者關(guān)于食品安全強制保險制度的研究進行簡單的對比分析。并對文章的整體結(jié)構(gòu)做了一個簡要的概括,最終目的是設(shè)計出符合我國國情的食品安全強制保險制度。第二部分關(guān)于食品安全責(zé)任強制保險相關(guān)制度的概述。具體分析責(zé)任保險制度、食品安全責(zé)任保險制度、強制保險制度的概念及特點,選取4個具有代表性的省份,對我國現(xiàn)階段開展食品安全責(zé)任保險的實踐工作進行分析�？偨Y(jié)實踐工作的反饋信息,結(jié)合我國目前食品領(lǐng)域的基本情況,分析構(gòu)建強制保險制度的必要性。第三部分對其他國家和地區(qū)的食品安全保障制度的具體分析。選取包括美國、歐盟、日本和我國臺灣地區(qū)在內(nèi)的四種不同的理論進行分析和總結(jié),為我國構(gòu)建食品安全責(zé)任強制保險制度打好理論基礎(chǔ)。第四部分是本文的核心章節(jié),即對于如何構(gòu)建食品安全責(zé)任強制保險制度的具體分析。本文參考傳統(tǒng)的強制保險理論以及借鑒外國和特別地區(qū)的經(jīng)驗,從宏觀和微觀兩個角度對該制度進行設(shè)計。一方面從宏觀上對該制度的設(shè)立模式、設(shè)立原則以及制度運營模式做出分析,另一方面從微觀上對保險主體、保險合同的成立與解除、保險責(zé)任等進行分析。最后一部分是對本文的總結(jié)。關(guān)于一項具體的制度出臺必須要經(jīng)過不斷的論證與分析才可以,最后在實踐中不斷地應(yīng)用,這樣才可以完整地設(shè)計出一套適用本國國情的制度。而根據(jù)我國目前的實踐,食品安全問題仍停留在責(zé)任保險的地步,對于何時能以強制險的身份出現(xiàn),任重而道遠。
[Abstract]:Since the exposure of the Sanlu milk powder incident, the issue of food safety has received much attention. Although the issue of food safety has been curbed by the effective management of the government and frequent media exposure, it has not been fundamentally eliminated.Toxic bean sprouts and other problematic foods are still eroding consumer safety.The significance of this study is not how to contain the recurrence of food safety problems, but how to better deal with the adverse effects of food problems and maintain economic and social stability after the occurrence of food problems.Specifically, by setting up a compulsory insurance system in the field of food, we can solve the problem that the victims do not get actual compensation in practice, as well as the dilemma that the enterprises are insolvent due to high compensation.And free the government from the problem of high compensation, so that it has more energy to solve the food safety problem.This paper is a study of the food safety compulsory insurance system, which is divided into five parts in structure, including: introduction, food safety liability compulsory insurance system related overview, extraterritorial food safety liability compulsory insurance system related theory overview,From the macro and micro two to complete the construction of the system and the conclusion of the article.The first part is introduction.This paper mainly introduces the research background, research methods, research value, as well as the domestic and foreign scholars about the food safety compulsory insurance system for a simple comparative analysis.The whole structure of the article is briefly summarized, and the final aim is to design a food safety compulsory insurance system in accordance with the national conditions of our country.The second part about the food safety liability compulsory insurance related system outline.The concept and characteristics of liability insurance system, food safety liability insurance system and compulsory insurance system are analyzed in detail. Four representative provinces are selected to analyze the practice of carrying out food safety liability insurance in our country at the present stage.This paper summarizes the feedback information of practical work and analyzes the necessity of constructing compulsory insurance system according to the basic situation of food field in China.The third part of the specific analysis of other countries and regions of food safety and security system.Four different theories, including the United States, the European Union, Japan and Taiwan, are selected to analyze and summarize, thus laying a good theoretical foundation for the construction of compulsory food safety liability insurance system in China.The fourth part is the core chapter of this paper, that is, how to construct the compulsory food safety liability insurance system.Referring to the traditional compulsory insurance theory and the experience of foreign countries and special regions, this paper designs the system from the macro and micro perspectives.On the one hand, it makes an analysis of the establishment model, the establishment principle and the operating mode of the system from the macro perspective; on the other hand, it analyzes the subject of insurance, the establishment and release of insurance contract, and the insurance liability.The last part is the summary of this paper.A concrete system must go through continuous demonstration and analysis, and finally it can be continuously applied in practice, so as to design a set of system which is suitable to the national conditions of our country.According to the current practice of our country, the problem of food safety is still in the situation of liability insurance, and there is a long way to go when it can appear as compulsory insurance.
