合作性勞動(dòng)關(guān)系法律調(diào)整研究

【摘要】:當(dāng)前,我國(guó)正處于經(jīng)濟(jì)社會(huì)轉(zhuǎn)型時(shí)期,勞動(dòng)關(guān)系的主體及其利益訴求越來越多元化,勞動(dòng)關(guān)系矛盾也已進(jìn)入凸顯期和多發(fā)期。勞動(dòng)關(guān)系也隨著經(jīng)濟(jì)體制改革的進(jìn)一步深化,更為靈活、更富彈性就業(yè)模式的逐漸興起,而有了新的發(fā)展。吸收勞動(dòng)者參與到公司、企業(yè)的管理運(yùn)行中事實(shí)上都已出現(xiàn)且并不少見,相關(guān)法律制度中也確立了勞動(dòng)者參與用人單位運(yùn)營(yíng)決策的各種模式。就實(shí)踐結(jié)果來看,勞動(dòng)者加入到用人單位的運(yùn)營(yíng)決策,對(duì)整體組織效益的增長(zhǎng)有著不容忽視的影響,然而現(xiàn)實(shí)是,勞動(dòng)者諸多的合法權(quán)益的保護(hù)尚有不足甚至缺失,并缺乏救濟(jì)合法權(quán)益的有效途徑。本文認(rèn)為當(dāng)前勞動(dòng)關(guān)系的合作性日益凸顯,其核心在于實(shí)現(xiàn)勞動(dòng)者對(duì)企業(yè)管理的有效參與。我國(guó)現(xiàn)有的職工代表大會(huì)制度,職工董事、職工監(jiān)事制度以及職工持股制度等,都是對(duì)合作性勞動(dòng)關(guān)系進(jìn)行法律調(diào)整的初步體現(xiàn)。接著結(jié)合英美法系、大陸法系的代表性國(guó)家,美、英、德、日四國(guó)的法律規(guī)范現(xiàn)狀,概括出西方國(guó)家勞動(dòng)關(guān)系合作性的法律調(diào)整現(xiàn)狀對(duì)我國(guó)的啟示。然后結(jié)合我國(guó)相關(guān)法律調(diào)整現(xiàn)狀的不足,認(rèn)為主要存在勞動(dòng)關(guān)系涵義認(rèn)定不清晰,職工持股制度立法缺位以及現(xiàn)有調(diào)整勞動(dòng)關(guān)系合作性的諸多法律制度虛化等問題。最后,提出明晰勞動(dòng)關(guān)系涵義的建議,并對(duì)于我國(guó)勞動(dòng)關(guān)系合作性相關(guān)法律制度的完善,具體結(jié)合職工持股制度,職工董事、監(jiān)事制度和職工代表大會(huì)制度,提供一些探索路徑,期望對(duì)我國(guó)良性合作性勞動(dòng)關(guān)系的構(gòu)建有所助益。
[Abstract]:At present, our country is in the period of economic and social transformation, the main body of labor relations and its interest demands are more and more diversified, the contradiction of labor relations has also entered the prominent period and the frequent period.With the deepening of the reform of economic system, the employment mode of labor relations is more flexible and more flexible, and has a new development.Absorbing workers to participate in the company, the management and operation of enterprises have in fact appeared and are not uncommon, the relevant legal system has also established a variety of models of workers participating in the decision-making of employers' operation.As far as practical results are concerned, the participation of workers in the operational decisions of employing units has a significant impact on the growth of overall organizational benefits. However, the reality is that the protection of many legitimate rights and interests of workers is still inadequate or even lacking.And the lack of effective ways to remedy the legitimate rights and interests.This paper argues that the cooperative nature of labor relations is increasingly prominent, the core of which is to realize the effective participation of laborers in the management of enterprises.The existing system of workers' Congress, staff directors, staff supervisors and employee stock ownership system are the preliminary embodiment of the legal adjustment of cooperative labor relations.Then combined with the representative countries of Anglo-American law system, continental law system, the United States, Britain, Germany, Japan four countries of the legal norms, summed up the western countries labor relations cooperative legal adjustment of the current situation of China's enlightenment.Then combined with the deficiency of the relevant legal adjustment in our country, the author thinks that there are some problems such as the definition of labor relations is not clear, the legislation of employee stock ownership system is absent, and the existing legal system of adjusting labor relations cooperation is empty, and so on.Finally, some suggestions are put forward to clarify the meaning of labor relations, and to perfect the related legal system of labor relations cooperation in China, specifically combining the system of employee stock ownership, the system of employee directors, supervisors and the system of workers' Congress.To provide some ways to explore the construction of benign cooperative labor relations in China.
