【摘要】：新制度的建構(gòu),需要保證制度內(nèi)部邏輯一貫,并處理好與已有制度間的銜接。我國(guó)環(huán)境公益訴訟制度的建構(gòu),在制度內(nèi)部關(guān)系上,需要完善人民檢察院提起環(huán)境民事公益訴訟的對(duì)象范圍要件、解決人民檢察院提起環(huán)境民事公益訴訟程序的沖突問(wèn)題、設(shè)置社會(huì)組織提起環(huán)境民事公益訴訟的前置條件等;在制度外部關(guān)系上,需要充分發(fā)揮刑事附帶民事訴訟制度的功能,協(xié)調(diào)新舊制度之間的關(guān)系,并根據(jù)環(huán)境行政主管部門、人民檢察院、社會(huì)組織等在維護(hù)環(huán)境公共利益方面的職責(zé)順序,確立相關(guān)環(huán)境行政主管部門、人民檢察院、社會(huì)組織等在環(huán)境公益訴訟制度中的主體地位,妥善處理環(huán)境公益訴訟制度與已有制度外部間的功能重疊問(wèn)題。
[Abstract]:The construction of the new system needs to ensure that the internal logic of the system is consistent and the connection between the existing system and the existing system is well handled.The construction of the environmental public interest litigation system in our country, in the internal relations of the system, it is necessary to perfect the object scope elements of the people's procuratorate to file the environmental civil public welfare lawsuit, to solve the conflict problem of the people's procuratorate bringing the environmental civil public welfare lawsuit procedure.Setting up pre-conditions for social organizations to initiate environmental civil public interest litigation, etc., in terms of the external relations of the system, it is necessary to give full play to the functions of the criminal incidental civil litigation system, to coordinate the relationship between the new and the old systems, and to coordinate the relationship between the new and the old systems in accordance with the environmental administrative departments,The order of responsibilities of the people's procuratorates and social organizations in safeguarding the environmental public interests, and the establishment of the principal position of the relevant environmental administrative departments, people's procuratorates and social organizations in the environmental public interest litigation system,Properly deal with the problem of overlapping functions between the environmental public interest litigation system and the existing system.
