【摘要】：地處貴州省東南部的黔東南苗族侗族自治州(以下簡稱“黔東南州”),水資源豐富,境內(nèi)大大小小的河流有兩千多條,水資源豐富促進(jìn)黔東南州人民的社會生活和經(jīng)濟發(fā)展,也成為當(dāng)?shù)刂匾膽?zhàn)略資源。在經(jīng)濟快速發(fā)展的當(dāng)下,黔東南州水資源污染問題越發(fā)嚴(yán)重,不管是地表水資源,還是地下水資源,都遭到各種程度的污染,黔東南人民的飲水安全也受到威脅。貴州省在大力發(fā)展生態(tài)文明建設(shè)的背景下,黔東南州搶抓生態(tài)文明建設(shè)試驗區(qū)的歷史機遇,在發(fā)展民族文化與生態(tài)旅游大州的戰(zhàn)略目標(biāo)下,以地區(qū)產(chǎn)業(yè)轉(zhuǎn)型為契機,優(yōu)化地區(qū)水資源配置成為重中之重。飲用水源是公民身體健康和生產(chǎn)生活的基本保障,保護(hù)飲用水源就是保護(hù)公民的生命安全。黔東南州在飲用水源保護(hù)方面卻沒有一部全面、系統(tǒng)的保護(hù)條例,了解黔東南州飲用水源法律保護(hù)狀況,從立法、司法、執(zhí)法和守法方面找到存在的問題,并依據(jù)問題提出對策,以期為黔東南州飲用水源提供切實可行的法律保護(hù),促進(jìn)黔東南州的生態(tài)文明建設(shè)。本文通過大量有關(guān)的文獻(xiàn)研究,對相關(guān)環(huán)保部門的訪談,結(jié)合田野調(diào)查得到的第一手資料,綜合分析黔東南州在飲用水源保護(hù)上存在的不足,在不違背上位法的前提條件下,試提出保護(hù)飲用水源的法律對策,希望對黔東南州飲用水源保護(hù)具有現(xiàn)實意義。本文主要分為以下四個部分:第一部分是緒論部分,主要介紹本文的研究意義和研究背景以及國內(nèi)外對飲用水源保護(hù)的研究情況。飲用水源作為黔東南州的重要戰(zhàn)略資源,對它的保護(hù)應(yīng)該成為加速貴州生態(tài)文明建設(shè)過程中的重要議題。第二部分是黔東南州飲用水源概述。分別從飲用水源的分布情況、水質(zhì)狀況和受污染原因三個方面進(jìn)行研究,為了找出飲用水受污染的原因深入受污染水源地進(jìn)行實地調(diào)查、走訪當(dāng)?shù)鼐用?并運用邏輯分析法對數(shù)據(jù)資料進(jìn)行整理,為下文對黔東南州飲用水源保護(hù)法律對策的提出做好鋪墊,進(jìn)一步提高措施的針對性。第三部分是對黔東南州飲用水源保護(hù)立法、司法、執(zhí)法、守法上的現(xiàn)狀及不足進(jìn)行分析。從國家法律層面到貴州省對飲用水源保護(hù)有效的法律規(guī)定,再到黔東南州對飲用水源保護(hù)的地方性法律規(guī)定,做一個層級的分析對比。利用搜集到的數(shù)據(jù)資料及案例,分析立法、司法、執(zhí)法、守法方面存在的不足之處,為闡述下文打下基礎(chǔ)。第四部分是對黔東南州飲用水源保護(hù)提出法律對策。根據(jù)前文整理分析的黔東南州飲用水源保護(hù)中存在的法律問題,結(jié)合當(dāng)?shù)氐膶嶋H情況,吸取國外的成功經(jīng)驗,從立法、司法、執(zhí)法和守法四個方面提出切實可行的法律對策。
[Abstract]:Located in the southeast of Guizhou Province, the Miao and Dong Autonomous Prefecture of Southeast Guizhou Province (hereinafter referred to as "Qiandongnan Prefecture") is rich in water resources and has more than 2,000 rivers large and small in its territory. Abundant water resources promote the social life and economic development of the people of Qiandongnan Prefecture.It has also become an important local strategic resource.With the rapid development of economy, the pollution problem of water resources in Qiandongnan prefecture is more and more serious. Both surface water resources and groundwater resources are polluted to various degrees, and the drinking water security of people in southeast Guizhou is also threatened.In Guizhou Province, under the background of vigorously developing ecological civilization construction, Qiandongnan prefecture grasps the historical opportunity of ecological civilization construction experimental area, under the strategic goal of developing national culture and ecotourism big prefecture, takes the regional industry transformation as the opportunity.Optimizing the allocation of regional water resources has become a top priority.Drinking water is the basic guarantee of citizen's health and production and life, and the protection of drinking water is to protect citizen's life safety.In Qiandongnan Prefecture, however, there is not a comprehensive and systematic protection regulation for drinking water sources. We understand the legal protection situation of drinking water sources in Qiandongnan prefecture, and find out the existing problems in the areas of legislation, justice, law enforcement and law-abiding.In order to provide practical legal protection for drinking water source of Qiandongnan prefecture and promote the construction of ecological civilization in Qiandongnan prefecture, the countermeasures are put forward.Through a large number of relevant literature studies, interviews with relevant environmental protection departments and first-hand information obtained from field investigations, this paper comprehensively analyzes the deficiencies in drinking water source protection in Qiandongnan Prefecture, without violating the premise of the upper law.This paper tries to put forward the legal countermeasures to protect drinking water source, hoping that it has practical significance for the protection of drinking water source in Qiandongnan Prefecture.This paper is divided into the following four parts: the first part is the introduction part, mainly introduces the research significance and research background of this paper, as well as the domestic and foreign research on the protection of drinking water sources.As an important strategic resource in Qiandongnan Prefecture, the protection of drinking water source should be an important topic in the process of accelerating the construction of ecological civilization in Guizhou.The second part is an overview of drinking water sources in Qiandongnan Prefecture.From the distribution of drinking water sources, water quality and the causes of pollution, in order to find out the causes of contaminated drinking water sources, conduct field investigations and visit local residents.In order to lay a good foundation for the legal countermeasures of drinking water source protection in Qiandongnan prefecture, and to further improve the pertinence of the measures, the author makes use of the logical analysis method to sort out the data.The third part analyzes the current situation and deficiency of the legislation, judicature, law enforcement and law-abiding of drinking water source protection in Qiandongnan Prefecture.From the national legal level to the effective legal provisions of drinking water source protection in Guizhou province, and then to the local legal provisions on drinking water source protection in Qiandongnan prefecture, this paper makes a hierarchical analysis and comparison.Using the collected data and cases to analyze the shortcomings of legislation, judicature, law enforcement and compliance with the law, lay a foundation for the elaboration of the following.The fourth part is to put forward legal countermeasures to the protection of drinking water source in Qiandongnan Prefecture.According to the legal problems existing in the protection of drinking water sources in Qiandongnan prefecture, combined with the local actual situation, and drawing on the successful experience of foreign countries, this paper puts forward some feasible legal countermeasures from four aspects: legislation, judicature, law enforcement and law-abiding.
