異地高考問(wèn)題的法律分析

【摘要】:我國(guó)實(shí)施改革開(kāi)放政策以來(lái),國(guó)家城鎮(zhèn)化速度加劇,且由于全國(guó)范圍內(nèi)經(jīng)濟(jì)發(fā)展的不平衡,出現(xiàn)了大規(guī)模的人口遷移,主要從農(nóng)村向城市遷移,經(jīng)濟(jì)不發(fā)達(dá)地區(qū)向城市發(fā)達(dá)地區(qū)遷移。城市和經(jīng)濟(jì)的發(fā)展本身也都需要大量的人力財(cái)力資源,人口的大量流動(dòng)就為遷入地帶去了強(qiáng)勁的發(fā)展動(dòng)力。然而,問(wèn)題也隨之出現(xiàn)了。移民們?cè)跒檫w入地創(chuàng)造價(jià)值的同時(shí)也需要占用當(dāng)?shù)氐馁Y源以謀求生存和發(fā)展。而由于種種的原因,他們的利益乃至隨遷子女的利益卻很難得到保障。其中,隨遷子女在遷入地的高考資格問(wèn)題近兩年就受到社會(huì)多方關(guān)注,近年來(lái),各地的異地高考政策也相繼出爐。異地高考是個(gè)復(fù)雜的社會(huì)問(wèn)題,本文主要從法律角度對(duì)異地高考的問(wèn)題進(jìn)行分析。 本文從2013年的一則異地高考的熱點(diǎn)新聞開(kāi)始,提出外來(lái)務(wù)工人員的隨遷子女在參加高考中面臨著很大困難的問(wèn)題,并表明在社會(huì)快速發(fā)展,生活方式巨大轉(zhuǎn)變的今天,此問(wèn)題意義重大,須要我們予以重視。本文主要分為五個(gè)部分:第一部分主要對(duì)異地高考的概念做了界定,通過(guò)與“高考移民”的比較進(jìn)一步明晰其內(nèi)涵;第二部分從我國(guó)的高考制度以及教育資源的分部等方面,對(duì)異地高考問(wèn)題的形成原因進(jìn)行了分析;第三部分從法律角度對(duì)公民的平等受教育權(quán)的內(nèi)涵進(jìn)行論述,并介紹了國(guó)際社會(huì)以及其他國(guó)家對(duì)保障公民平等受教育權(quán)所做的努力;第四部分對(duì)我國(guó)中央及各地政府在促進(jìn)異地高考,推進(jìn)受教育平等權(quán)實(shí)現(xiàn)中的取得的成果進(jìn)行論述;第五部分從立法以及司法角度,指出我國(guó)在保障公民平等受教育權(quán)方面存在的不足。在立法方面,表現(xiàn)在具體部門法律的欠缺。在司法方面,主要針對(duì)行政訴訟中受案范圍過(guò)于狹窄問(wèn)題,和憲法在司法實(shí)務(wù)中的應(yīng)用標(biāo)準(zhǔn)不明問(wèn)題,進(jìn)行闡述。隨之,根據(jù)我國(guó)的具體情況,提出了相關(guān)的完善建議。
[Abstract]:Since the implementation of the policy of reform and opening to the outside world, the speed of national urbanization has intensified, and because of the imbalance in economic development throughout the country, large-scale population migration has occurred, mainly from rural to urban areas.Economically underdeveloped areas migrate to urban developed areas.Urban and economic development itself also needs a lot of human and financial resources.However, problems also arise.While creating value for the migrants, they also need to occupy local resources for survival and development.For various reasons, their interests and even the interests of their children are difficult to be protected.Among them, the issue of college entrance examination qualification of children moving in the place of relocation has been concerned by many social parties in the past two years, and in recent years, the policy of college entrance examination in different places has been published one after another.College entrance examination in different places is a complicated social problem.This paper begins with a hot news about the college entrance examination in different places in 2013, and points out that the children of migrant workers are facing great difficulties in participating in the college entrance examination. It also shows that today, with the rapid development of society and the great change of life style, it is difficult for the children of migrant workers to take part in the college entrance examination.This issue is of great significance and needs our attention.This paper is divided into five parts: the first part mainly defines the concept of the college entrance examination in different places, and clarifies its connotation through the comparison with the "college entrance examination emigration". The second part is from the aspects of the college entrance examination system and the division of educational resources in our country.The third part discusses the connotation of citizens' equal right to education from the angle of law, and introduces the efforts made by the international community and other countries to guarantee citizens' equal right to education.The fourth part discusses the achievements made by the central and local governments in promoting the college entrance examination in different places and promoting the realization of the right to equality in education. The fifth part is from the angle of legislation and judicature.Pointed out that our country in the protection of citizens equal right to education there are shortcomings.In the legislative aspect, displays in the specific sector law insufficiency.In the judicial aspect, mainly aims at the administrative lawsuit receives the case scope to be too narrow, and the constitution in the judicial practice application standard question, carries on the elaboration.Then, according to the concrete situation of our country, put forward the related consummation suggestion.
