【摘要】:征信活動,涉及數(shù)據(jù)的征集、處理和使用,而數(shù)據(jù)的全面性決定了征信報告的權(quán)威性。經(jīng)我國政府多年推動,現(xiàn)已逐漸形成覆蓋面較全的公共信用信息數(shù)據(jù)庫和金融信用信息數(shù)據(jù)庫。然而,近年來,基于信息孤島現(xiàn)象嚴重,我國征信行業(yè)面臨著難以深化發(fā)展的困境,而數(shù)據(jù)共享機制不完善則是困境產(chǎn)生的重要原因。從征信活動參與者間關系的角度切入,可明晰數(shù)據(jù)共享參與者面臨的具體難題,一方面是商談機制的缺失,另一方面是保護機制的缺位,必須結(jié)合理論分析和總結(jié)國內(nèi)外經(jīng)驗,建立適合我國國情的商談機制以及數(shù)據(jù)主體保護機制。
[Abstract]:The activity of credit information involves the collection, processing and use of data, and the comprehensiveness of the data determines the authority of the report.After years of promotion by the Chinese government, the public credit information database and the financial credit information database with complete coverage have been gradually formed.However, in recent years, due to the phenomenon of information isolated islands, the credit information industry in our country is facing the dilemma that it is difficult to deepen its development, and the imperfect mechanism of data sharing is the important reason for the difficulties.From the angle of the relationship between the participants in the credit-checking activities, it is clear that the specific difficulties faced by the participants in data sharing, on the one hand, the absence of the negotiation mechanism, and the absence of the protection mechanism on the other hand, must be combined with theoretical analysis and summing up the domestic and foreign experience.Set up the negotiation mechanism and the data subject protection mechanism suitable for our country's national conditions.
