【摘要】：如今,我國的農(nóng)村環(huán)境侵權(quán)問題已經(jīng)成為制約我國經(jīng)濟(jì)發(fā)展和社會(huì)進(jìn)步的不和諧因素。在剛剛閉幕的黨的十八屆三中全會(huì)上,生態(tài)文明建設(shè)再次成為亮點(diǎn),建立健全我國的生態(tài)法律制度體系是我國生態(tài)文明建設(shè)的第一要?jiǎng)?wù),解決我國農(nóng)村環(huán)境侵權(quán)問題是我國生態(tài)法律制度體系的重中之重。 本篇論文通過實(shí)證分析的方法、價(jià)值分析等方法,首先對環(huán)境侵權(quán)進(jìn)行釋義,然后通過對農(nóng)村環(huán)境侵權(quán)的主體、客體和介質(zhì)進(jìn)行分析后給農(nóng)村環(huán)境侵權(quán)下定義。通過相關(guān)案例總結(jié)出我國農(nóng)村環(huán)境侵權(quán)的特征。對于農(nóng)村環(huán)境侵權(quán)特征的分析可以使我們更加準(zhǔn)確的認(rèn)識農(nóng)村環(huán)境侵權(quán)問題。接下來,論文分別從立法、司法、執(zhí)法、公眾參與的角度提出我國農(nóng)村環(huán)境侵權(quán)問題存在的法律制度困境。并提出相應(yīng)的解決思路,如更新立法理念、建設(shè)環(huán)保法庭、開展環(huán)境公益訴訟、環(huán)境執(zhí)法與司法協(xié)同、設(shè)立農(nóng)村環(huán)保組織和增強(qiáng)農(nóng)民環(huán)保意識。 在現(xiàn)實(shí)生活中,常常會(huì)發(fā)生一些農(nóng)民因不知道如何維權(quán)而自認(rèn)倒霉的窘境,這使得處在弱勢的農(nóng)村居民不能夠及時(shí)、合理的得到賠償,污染者和企業(yè)也逍遙法外。因此,對我國農(nóng)村環(huán)境侵權(quán)問題的研究有利于農(nóng)民權(quán)益的保護(hù)、農(nóng)村環(huán)境的保護(hù),也深刻反映了以習(xí)近平為總書記的黨中央著眼維護(hù)廣大人民最根本的利益,維護(hù)中華民族的長久利益,致力于生態(tài)文明建設(shè)的決心。
[Abstract]:Today, the problem of environmental tort in rural areas in China has become a disharmonious factor restricting our economic development and social progress. At the recently concluded third Plenary session of the 18th CPC Central Committee, the construction of ecological civilization was once again a bright spot. Establishing and perfecting our country's ecological legal system is the most important task of our country's ecological civilization construction. It is the most important task of our country's ecological legal system to solve the problem of environmental tort in our country's countryside. Through the methods of empirical analysis and value analysis, this paper first interprets the environmental tort, and then through the main body of rural environmental tort, After analyzing the object and the medium, we define the rural environmental tort. Through the relevant cases, we summarize the characteristics of the rural environmental tort in China. The analysis of the rural environmental tort characteristics can make us understand the rural environment more accurately. Boundary infringement. Next, From the angle of legislation, judicature, law enforcement and public participation, the paper puts forward the dilemma of the legal system of environmental tort in rural areas of our country, and puts forward the corresponding solutions, such as updating the legislative concept, building environmental protection courts. Environmental public interest litigation, environmental law enforcement and judicial cooperation, setting up rural environmental protection organizations and enhancing farmers' awareness of environmental protection. In real life, there is often a dilemma for farmers who do not know how to protect their rights. This makes it impossible for the disadvantaged rural residents to be compensated in a timely and reasonable manner, and the polluters and enterprises are also at large. The study of environmental tort in rural areas in China is conducive to the protection of farmers' rights and interests. The protection of the rural environment also profoundly reflects the fundamental interests of the broad masses of the people that have been safeguarded by the Party Central Committee with Xi Jinping as its general secretary. Safeguarding the long-term interests of the Chinese nation and devoting to the construction of ecological civilization.
