【摘要】:近年來,國內(nèi)的食品安全事故頻頻出現(xiàn),極大地危害著社會大眾的生命健康,有關(guān)新聞屢見不鮮,因此,食品安全問題已然變成了整個社會的熱點問題。這類安全事故不斷出現(xiàn),使得受到傷害的大眾身體健康難以獲得保證,同時相關(guān)的產(chǎn)品制造企業(yè)也不得不瀕臨破產(chǎn)。而食品制造企業(yè)假如發(fā)生了破產(chǎn),那么相應(yīng)地,他們的職工和背后的家庭生活將受到影響。為有效扭轉(zhuǎn)目前國內(nèi)食品安全的不利局面,推動這一產(chǎn)業(yè)的健康成長,健全受害人救濟機制,減輕政府在財政方面的支出,國內(nèi)要迅速就食品安全強制責任保險問題進行立法規(guī)定。文章重點探討食品安全強制責任保險立法,對于域外立法情況進行歸納總結(jié),研究國內(nèi)立法所具有的必要性和可行性,同時給出了相應(yīng)的立法建構(gòu)方面的設(shè)計建議。文章一共分為四個部分,第一部分以食品安全強制責任保險相關(guān)基礎(chǔ)理論為切入點,對于責任保險、食品安全強制責任保險等諸多概念加以研究確定。之后,文章闡述了食品安全強制責任保險所具有的三大法律特征,也就是法定強制性、社會公益性以及法定強制性和商業(yè)性并存。同時立足法學、經(jīng)濟學等視角,以公共強制、法律不完備與信息不對稱三大理論作為支撐基礎(chǔ),使得食品安全強制責任保險立法獲得了相應(yīng)的理論基礎(chǔ)。第二部分,文章簡要地介紹了歐美以及我國臺灣地區(qū)的立法情況,重點就其中符合中國實際情況的相關(guān)立法經(jīng)驗作了研究;第三部分,文章重點選擇了食品產(chǎn)業(yè)平穩(wěn)成長、健全受害人救濟機制、移轉(zhuǎn)食品企業(yè)經(jīng)營風險與減輕政府財政支出四大視角闡述了國內(nèi)在這方面進行立法的必要性,同時選擇了立法根據(jù)、現(xiàn)實基礎(chǔ)與實踐經(jīng)驗三大視角論述了國內(nèi)進行立法的可行性。第四部分,文章基于審慎科學、社會效益與及時理賠三大基礎(chǔ)原則,從經(jīng)營模式、投保人、責任范圍等六大內(nèi)容出發(fā),給出了國內(nèi)食品安全強制責任保險立法方面的基本構(gòu)想。
[Abstract]:In recent years, food safety accidents appear frequently in China, which greatly endanger the life and health of the public. The related news is common. Therefore, food safety has become a hot issue in the whole society.Such safety incidents continue to make it difficult to guarantee the health of the injured public, and the associated manufacturers have to be on the verge of bankruptcy.If food manufacturers go bankrupt, their employees and the family life behind them will be affected.In order to effectively reverse the current adverse situation of domestic food security, promote the healthy growth of the industry, improve the victim relief mechanism, and reduce government expenditure in the financial area,The domestic should carry on the legislation stipulation to the food safety compulsory liability insurance question quickly.This paper focuses on the legislation of compulsory liability insurance for food safety, summarizes the situation of legislation outside the country, studies the necessity and feasibility of domestic legislation, and gives some design suggestions on the legislative construction.The article is divided into four parts. The first part is based on the basic theory of food safety compulsory liability insurance, and studies and determines many concepts such as liability insurance, food safety compulsory liability insurance and so on.After that, the article expounds the three legal characteristics of the compulsory liability insurance for food safety, that is, the mandatory law, the public welfare, and the coexistence of the mandatory and commercial nature of the law.At the same time, based on the perspectives of law and economics, and based on the three theories of public coercion, incomplete law and asymmetric information, the legislation of compulsory liability insurance for food safety has obtained the corresponding theoretical basis.In the second part, the article briefly introduces the legislation situation of Europe, America and Taiwan, and focuses on the relevant legislative experience which is in line with the actual situation in China, the third part, the article focuses on the smooth growth of the food industry.Perfecting the victim relief mechanism, transferring the operating risk of food enterprises and reducing the government financial expenditure, this paper expounds the necessity of domestic legislation in this respect, and chooses the legislative basis.This paper discusses the feasibility of legislation in China from the three perspectives of realistic basis and practical experience.In the fourth part, based on the three basic principles of prudent science, social benefit and timely settlement of claims, the author puts forward the basic conception of the legislation of compulsory liability insurance for food safety in China from the six aspects of business model, policy holder and liability scope.
