【摘要】：隨著食品安全事故相關(guān)的曝光日益增多,廣大民眾對該問題的關(guān)心也持續(xù)升溫。不管是從個人層面,還是從社會層面,這些食品安全事故都帶來了不可估量的負面影響。在事故發(fā)生后,如何讓受害人得到應(yīng)有的補償十分重要。本文為了研究這個問題,從食品安全相關(guān)的理論出發(fā),分析我國缺陷食品損害賠償制度存在的問題,進而對完善該制度提出針對性的建議。除前言和結(jié)束語之外,本文主要包括以下四章內(nèi)容：第一章是我國缺陷食品損害賠償?shù)母攀觥Ｖ饕榻B了概念,總結(jié)了缺陷食品致人損害的特點,分析了缺陷食品損害賠償責(zé)任的構(gòu)成。第二章是缺陷食品損害賠償機制。在該部分中,分析了該法律關(guān)系的主體與客體,隨后著重分析了該機制所涉及的眾多原則,其中對懲罰性賠償原則做了詳細介紹。第三章是對缺陷食品損害賠償制度的評價。經(jīng)過前文中對相關(guān)理論與規(guī)定的介紹,結(jié)合具體實際,從歸責(zé)原則、舉證責(zé)任、賠償范圍、懲罰性賠償以及實施障礙各方面逐一點評。第四章是對完善該制度提出相應(yīng)地建議。建議與前文中的問題一一對應(yīng),以求具有針對性。此外,該部分還從責(zé)任保險和賠償基金兩方面提出完善社會化救濟機制的建議。
[Abstract]:With the exposure of related food safety accidents are increasing, the general public concern on this issue continues to rise. No matter from a personal level, or from the social level, these food safety accidents have brought incalculable negative impact. After the accident, how to let the victims receive due compensation is very important. In order to study the the problem of food safety, starting from the relevant theory, analysis of the existing system of compensation for damage of defective food in our country, and to consummate the system put forward some suggestions. Besides the preface and conclusion, this paper includes the following four chapters: the first chapter is the overview of the compensation for damage of defective food in our country. It mainly introduces the concept of and summarizes the characteristics of the damage caused by the defective food, analyzing the defects of food damages constitute liability. The second chapter is the compensation mechanism of defective food damage. In the part of Analysis of the legal relationship, subject and object, then analyzes the principle of the many mechanisms involved, which introduces the punitive compensation principle. The third chapter is the evaluation of the system of compensation for damage of defective food. After the introduction of relevant theories and provisions of the above, the actual range from to the responsibility principle, the burden of proof, compensation, the punitive damages as well as obstacles to the implementation of each comment. The fourth chapter is the corresponding suggestions to improve the system. Put forward suggestions and problems in previous correspondence, in order to targeted. In addition, this part also proposes to perfect social relief mechanisms from two aspects of liability insurance and compensation fund advice.
