【摘要】：當前,我國警察使用武器的案件日益增多,如何規(guī)范及保障警察使用武器的問題引起社會各界的廣泛關注。本文通過梳理我國《人民警察法》、《刑法》、《中華人民共和國人民警察使用警械和武器條例》等法律法規(guī)關于警察使用武器的規(guī)定,結合具體案例闡述當前我國警察普遍存在不敢、不愿、不善使用武器的問題,并剖析這主要是由于我國現(xiàn)有關于警察使用武器的法律法規(guī)過于原則性、操作性不強、保障不力等原因造成的,通過分析借鑒外國一些國家關于警察使用武器的有關規(guī)定以及國內(nèi)外部分專家學者的觀點,結合我國當前法治水平不高、警察比例偏低的特點,建議根據(jù)《立法法》的精神提出應通過制定高位階的《中華人民共和國人民警察使用警械和武器法》,用原則壓縮警察使用武器的自由裁量權,盡量用客觀描述而非主觀表達,細化各種可以、禁止、不得使用武器的情形,加大警察執(zhí)法權威,使警察明晰應如何合法高效地使用武器打擊違法犯罪行為,更好地保護人民生命及財產(chǎn)安全的同時能更好地保護自己。
[Abstract]:At present, the use of weapons by the police in our country is increasing day by day. How to standardize and guarantee the use of weapons by the police has attracted wide attention from all walks of life in the society. In this paper, laws such as the people's Police Law, the Criminal Law and the regulations of the people's Republic of China on the use of Police equipment and weapons have been introduced. Regulations governing the use of weapons by the police, Combined with specific cases, this paper expounds that the current problems of police officers in our country are generally afraid, unwilling and not good at using weapons, and analyzes this mainly because the existing laws and regulations on the use of weapons by the police in our country are too principled and not operational. Through the analysis of the relevant regulations of some foreign countries on the use of weapons by the police and the views of some experts and scholars at home and abroad, combined with the characteristics of the low level of the rule of law and the low proportion of police officers in our country at present, It is suggested that according to the spirit of the Legislative Law, the people's Republic of China's Law on the use of Police equipment and weapons should be formulated at a high level, and that the discretionary power of the police to use weapons should be reduced by principle, and that the objective description rather than the subjective expression should be used as far as possible. To refine the circumstances in which weapons can, prohibit and cannot be used, to increase the authority of the police in enforcing the law, and to make clear to the police how to use weapons legally and efficiently to crack down on illegal and criminal acts. Better protection of people's lives and property security at the same time can better protect themselves.
