【摘要】：放生活動(dòng)作為一種宗教習(xí)俗在我國(guó)有著悠久的歷史和一定的群眾基礎(chǔ)。由于缺乏專(zhuān)業(yè)指導(dǎo)和監(jiān)管,放生引起了環(huán)境污染、生態(tài)入侵等危害自然生態(tài)系統(tǒng)和生態(tài)安全的事件,造成大量放生動(dòng)物無(wú)效死亡、危害公共安全、助長(zhǎng)非法獵捕等,影響放生地居民正常的生產(chǎn)生活,給野生動(dòng)物保護(hù)與管理帶來(lái)隱患,同時(shí)也違背了放生"尊重生命"的本意。2016年新修訂的《中華人民共和國(guó)野生動(dòng)物保護(hù)法》將動(dòng)物放生納入管理范圍,使對(duì)動(dòng)物放生的監(jiān)管有了明確的法律依據(jù)和支持,切合我國(guó)自然保護(hù)的現(xiàn)實(shí)需求。為實(shí)現(xiàn)對(duì)放生活動(dòng)的科學(xué)監(jiān)管,本文建議繼續(xù)完善法規(guī)來(lái)加強(qiáng)放生管理,明確監(jiān)管部門(mén),制定放生管理的技術(shù)標(biāo)準(zhǔn)和管理制度,提出包括放生環(huán)境選址、放生動(dòng)物規(guī)模、放生動(dòng)物適合度、放生時(shí)間地點(diǎn)和放生監(jiān)測(cè)方案等指標(biāo)的放生技術(shù)標(biāo)準(zhǔn),以期為放生提供制度和技術(shù)保障,使動(dòng)物放生得以科學(xué)、有序、安全開(kāi)展。同時(shí),放生本質(zhì)上仍然是人類(lèi)對(duì)自然生態(tài)系統(tǒng)的干擾,科學(xué)放生的終極目標(biāo)應(yīng)為取消放生,建議通過(guò)更新觀念、開(kāi)展動(dòng)物及棲息地保護(hù)來(lái)實(shí)現(xiàn)關(guān)愛(ài)動(dòng)物的放生目的。
[Abstract]:As a religious custom in China, the activities of releasing life have a long history and a certain mass base. Due to the lack of professional guidance and supervision, the release of life has caused environmental pollution, ecological invasion and other incidents that endanger the natural ecosystem and ecological security. Causing invalid deaths of a large number of released animals, endangering public safety, encouraging illegal hunting and catching, affecting the normal production and life of the residents of the released areas, and bringing hidden dangers to the protection and management of wild animals. At the same time, it also runs counter to the original intention of "respecting life." the 2016 revised Wildlife Protection Law of the people's Republic of China has brought animal release into the scope of management, which has provided a clear legal basis and support for the regulation of animal release. In order to realize the scientific supervision of the release activities, this paper suggests that we should continue to improve the laws and regulations to strengthen the management of release, make clear the supervision department, and formulate the technical standard and management system of the release management. In order to provide the system and technical guarantee for the release of animals, the technical standard of release including the location of the environment, the scale of the released animal, the suitability of the released animal, the time and place of the release and the monitoring scheme of the release of the animal were put forward, in order to provide the system and technical guarantee for the release of the animal, so that the animal can be released scientifically. At the same time, the nature of release is still human interference to the natural ecosystem. The ultimate goal of scientific release should be to cancel the release. Develop animal and habitat protection to achieve the purpose of animal release.
