【摘要】:伴隨著市場(chǎng)經(jīng)濟(jì)的發(fā)展,民主政治的進(jìn)步,現(xiàn)代行政管理理念的變革,行政合同作為一種靈活有效的行政管理方式在實(shí)踐中被廣泛應(yīng)用,但關(guān)于行政合同爭(zhēng)議處理的司法制度卻不甚完善。在理論研究層面,由于我國(guó)行政合同制度起步較晚,行政合同理論深受民商法理論影響,尚未形成行政合同爭(zhēng)議訴訟救濟(jì)制度的完整理論體系,在許多問(wèn)題上還存有分歧與爭(zhēng)議;在立法方面,相關(guān)法律法規(guī)匱乏,缺乏對(duì)行政合同發(fā)展的有效指導(dǎo);在我國(guó)現(xiàn)有的司法實(shí)踐中,因行政合同引發(fā)的爭(zhēng)端越來(lái)越多,但爭(zhēng)端的解決情況并不樂(lè)觀。一方面行政合同爭(zhēng)議案件很少進(jìn)入司法程序,另一方面,即便進(jìn)入訴訟程序,也多被當(dāng)做普通民事合同交由民事審判庭進(jìn)行審理。行政合同爭(zhēng)議案件的訴訟管轄現(xiàn)狀極其混亂,大部分基層法院,不管是民事審判庭還是行政審判庭都只是在不違法的前提下以打擦邊球的態(tài)度來(lái)對(duì)行政合同案件進(jìn)行審理。因此,為了完善行政合同理論,充分保障公民的合法權(quán)益,使行政合同在實(shí)踐中更好的發(fā)揮作用,必須對(duì)行政合同爭(zhēng)議的訴訟救濟(jì)制度進(jìn)行變革。 本文以我國(guó)的行政合同實(shí)踐與理論為基礎(chǔ),同時(shí)參照域外行政合同的司法制度,認(rèn)為完善行政合同爭(zhēng)議的訴訟救濟(jì),首先應(yīng)當(dāng)從理論上明確行政合同的定義和范圍,減少分歧與爭(zhēng)議。其次,借助修改行政訴訟法的契機(jī),呼應(yīng)擴(kuò)大行政訴訟受案范圍的主題,將行政合同爭(zhēng)議納入到行政訴訟受案范圍中去,交由行政審判庭進(jìn)行審理,并引入和解制度和調(diào)解制度。同時(shí),為避免在司法實(shí)踐中出現(xiàn)糾紛,要通過(guò)立法明確行政合同爭(zhēng)議的原告范圍,并重點(diǎn)關(guān)注行政合同中第三人的權(quán)利保障問(wèn)題,完善相關(guān)的規(guī)定。再次,在法律適用上,因?yàn)樾姓贤陨砑婢摺靶姓浴迸c“合同性”,所以行政合同爭(zhēng)議案件的審理并不排斥私法的適用,在有特別法的情況下適用特別法,沒(méi)有特別法的情況下可以適用合同法。最后,文章分析了因行政合同特殊性而產(chǎn)生的其他問(wèn)題,包括行政合同優(yōu)益權(quán)存在的合理性及其法律規(guī)制,對(duì)行政合同前行政行為的法律規(guī)制及在訴訟中對(duì)行政合同的審查與對(duì)其他行政行為審查交叉的處理。
[Abstract]:With the development of market economy, the progress of democratic politics and the change of modern administration idea, administrative contract is widely used in practice as a flexible and effective way of administration. However, the judicial system of administrative contract dispute settlement is not perfect. At the theoretical level, the theory of administrative contract is deeply influenced by the theory of civil and commercial law because of the late start of administrative contract system in our country. It has not formed the complete theoretical system of the litigation relief system of administrative contract dispute, and there are still differences and disputes on many issues, in the legislative aspect, the relevant laws and regulations are scarce, lack of effective guidance to the development of the administrative contract; In the current judicial practice of our country, there are more and more disputes caused by administrative contracts, but the settlement of disputes is not optimistic. On the one hand, administrative contract disputes rarely enter the judicial procedure, on the other hand, even if they do, Most of them are referred to the civil court for trial as ordinary civil contracts. The status quo of litigation and jurisdiction in administrative contract disputes cases is extremely chaotic. Most of the grass-roots courts, Both the civil court and the administrative court are only trying administrative contract cases on the premise of not breaking the law. Therefore, in order to perfect the theory of administrative contracts and fully protect the legitimate rights and interests of citizens, In order to make the administrative contract play a better role in practice, it is necessary to reform the litigation relief system of the administrative contract dispute. Based on the practice and theory of administrative contract in our country, and referring to the judicial system of foreign administrative contract, this paper holds that the definition and scope of administrative contract should be defined theoretically to perfect the litigation relief of administrative contract dispute. Second, with the opportunity of amending the Administrative procedure Law, we should echo the theme of expanding the scope of administrative litigation cases, bring administrative contract disputes into the scope of administrative litigation cases, and hand them over to the Administrative trial Chamber for trial. At the same time, in order to avoid disputes in judicial practice, we should make clear the scope of plaintiff in administrative contract dispute through legislation, and focus on the protection of the rights of the third party in the administrative contract. Third, in the application of the law, because the administrative contract itself is both "administrative" and "contractual", the trial of administrative contract disputes does not exclude the application of private law, and applies the special law when there is a special law. Finally, the article analyzes other problems arising from the particularity of administrative contract, including the rationality of the existence of preferential right of interest in administrative contract and its legal regulation. The legal regulation of administrative act before administrative contract and the overlapping treatment between the examination of administrative contract and the examination of other administrative act in litigation.
