【摘要】：自20世紀(jì)80年代開始到21世紀(jì)的今天,在國(guó)家經(jīng)濟(jì)日益繁榮的同時(shí),社會(huì)公益慈善事業(yè)也在蒸蒸日上的發(fā)展�；ヂ�(lián)網(wǎng)的發(fā)展使得慈善日益興盛,網(wǎng)絡(luò)與公益慈善的結(jié)合突破了傳統(tǒng)慈善的困境。網(wǎng)絡(luò)慈善主要的代表是網(wǎng)絡(luò)慈善基金、網(wǎng)絡(luò)眾籌和網(wǎng)絡(luò)捐贈(zèng),其中網(wǎng)絡(luò)捐贈(zèng)是廣大網(wǎng)友參與網(wǎng)絡(luò)公益最多的方式。網(wǎng)絡(luò)捐贈(zèng)在各個(gè)方面都發(fā)揮著積極的作用,最常見的是在救助失學(xué)貧困兒童、救助身患重病無資金救治的病人、救助自然災(zāi)害地區(qū)的人民等等。隨著互聯(lián)網(wǎng)+時(shí)代的到來,我國(guó)慈善事業(yè)的發(fā)展方向也從傳統(tǒng)的慈善轉(zhuǎn)向網(wǎng)絡(luò)慈善,而網(wǎng)絡(luò)捐贈(zèng)表現(xiàn)尤為突出。但是,法律制度的發(fā)展總是滯后于現(xiàn)實(shí)的發(fā)展。在我國(guó),關(guān)于網(wǎng)絡(luò)捐贈(zèng)方面的法律制度相對(duì)薄弱,導(dǎo)致網(wǎng)絡(luò)捐贈(zèng)活動(dòng)無法得到有效規(guī)制,網(wǎng)絡(luò)捐贈(zèng)領(lǐng)域亂象頻發(fā),完善網(wǎng)絡(luò)捐贈(zèng)活動(dòng)的法律規(guī)制已迫在眉睫。本文主要以研究網(wǎng)絡(luò)捐贈(zèng)的現(xiàn)狀,從中總結(jié)出問題,進(jìn)而對(duì)其問題進(jìn)行規(guī)制為主。第一部分主要闡明了選題的社會(huì)背景和現(xiàn)狀,對(duì)選題的意義進(jìn)行剖析、研究國(guó)內(nèi)外網(wǎng)絡(luò)捐贈(zèng)的現(xiàn)狀,同時(shí)闡明本文的研究思路、方法和創(chuàng)新點(diǎn)。主要分析了我國(guó)傳統(tǒng)慈善事業(yè)出現(xiàn)的種種困境,隨著網(wǎng)絡(luò)的發(fā)展,慈善與網(wǎng)絡(luò)相結(jié)合孕育了新型的慈善模式,即網(wǎng)絡(luò)捐贈(zèng)。同時(shí)通過研究國(guó)內(nèi)外的網(wǎng)絡(luò)現(xiàn)狀來總結(jié)現(xiàn)在網(wǎng)絡(luò)捐贈(zèng)慈善的特點(diǎn)。第二部分主要針對(duì)網(wǎng)絡(luò)捐贈(zèng)的概念、特點(diǎn)、性質(zhì)及其存在和發(fā)展的基礎(chǔ)進(jìn)行總結(jié),通過對(duì)網(wǎng)絡(luò)捐贈(zèng)現(xiàn)象的總結(jié)和歸納,總結(jié)出網(wǎng)絡(luò)捐贈(zèng)的特點(diǎn),根據(jù)網(wǎng)絡(luò)與慈善相結(jié)合的發(fā)展進(jìn)程,歸納出網(wǎng)絡(luò)捐贈(zèng)存在的基礎(chǔ),進(jìn)而為下文網(wǎng)絡(luò)捐贈(zèng)的問題進(jìn)行鋪墊。第三部分主要對(duì)域外的網(wǎng)絡(luò)捐贈(zèng)國(guó)家的情況及法律規(guī)制進(jìn)行闡述,并從中吸取對(duì)我國(guó)網(wǎng)絡(luò)捐贈(zèng)法律制度發(fā)展的經(jīng)驗(yàn)。主要從網(wǎng)絡(luò)發(fā)展發(fā)達(dá)的英國(guó)和美國(guó)出發(fā),對(duì)其現(xiàn)行的法律規(guī)范進(jìn)行研究,通過對(duì)英美兩國(guó)法律制度的研究并結(jié)合我國(guó)的情況,總結(jié)出英美兩國(guó)和我國(guó)之間存在的不同以及我國(guó)網(wǎng)絡(luò)發(fā)展需要借鑒英美兩國(guó)的優(yōu)秀經(jīng)驗(yàn)。第四部分與第五部分分別是從網(wǎng)絡(luò)捐贈(zèng)的現(xiàn)狀中總結(jié)問題及針對(duì)問題提出的法律完善措施,主要存在的問題主要有捐贈(zèng)主體、受贈(zèng)主體、網(wǎng)絡(luò)平臺(tái)三方的權(quán)利和義務(wù);捐贈(zèng)信息的真實(shí)性問題;善款的使用情況以及各方主體的自律及受監(jiān)督等,同時(shí)也針對(duì)問題提出了相應(yīng)的措施,比如明確細(xì)化各個(gè)主體的權(quán)利義務(wù),主要是針對(duì)網(wǎng)絡(luò)平臺(tái)的準(zhǔn)入制度;實(shí)時(shí)詳細(xì)公布捐贈(zèng)信息;善款的使用及執(zhí)行情況;建立健全各方的監(jiān)督管理機(jī)制及明確各方的責(zé)任等。
[Abstract]:From 1980s to 21th century, with the prosperity of the national economy, the social welfare and philanthropy is also booming. The development of the Internet makes philanthropy flourish day by day. The combination of network and charity has broken through the dilemma of traditional charity. The main representatives of online charity are online charitable funds, online crowdfunding and online donations. Among them, network donation is the most popular way for netizens to participate in the public welfare of the network. Online donation plays a positive role in all aspects. The most common is to help poor children who are out of school, to help patients who are seriously ill without funds to treat them. With the advent of the Internet era, the development direction of philanthropy in our country has also shifted from traditional charity to network charity, and the performance of online donation is particularly outstanding. The development of legal system always lags behind the development of reality. In our country, the legal system of network donation is relatively weak, resulting in the network donation activities can not be effectively regulated. It is urgent to perfect the legal regulation of network donation. This paper mainly studies the status quo of network donation, sums up the problems, and then regulates the problems. The first part mainly expounds the social background and current situation of the topic. This paper analyzes the significance of the topic, studies the current situation of online donation at home and abroad, and clarifies the research ideas, methods and innovations of this paper. It mainly analyzes the difficulties of traditional philanthropy in China, along with the development of the network. The combination of charity and network gives birth to a new type of charity mode, namely, network donation. At the same time, it summarizes the characteristics of network donation charity by studying the current situation of network donation at home and abroad. The second part mainly aims at the concept and characteristics of network donation. The nature and the foundation of its existence and development are summarized. Through the summary and induction of the phenomenon of network donation, the characteristics of network donation are summed up. According to the development process of the combination of network and charity, the foundation of the existence of network donation is concluded. The third part mainly expounds the situation and legal regulation of the overseas countries of network donation. And draw lessons from the experience of the development of the legal system of network donation in our country. Starting from the United Kingdom and the United States, where the network is developed, this paper studies its current legal norms, and through the study of the legal systems of the United States and the United States, it combines the situation of our country. The differences between the two countries and our country are summarized, and the network development of our country needs to draw lessons from the excellent experience of the two countries. Part 4th and part 5th respectively summarize the problems from the current situation of network donation and put forward some suggestions. Measures to improve the law, The main problems are the rights and obligations of the donor, the grantee, the network platform, the authenticity of the donation information, the use of the donation, the self-discipline and supervision of the parties, etc. At the same time, it also puts forward the corresponding measures, such as clarifying the rights and obligations of each subject, mainly aiming at the access system of the network platform; announcing the donation information in real time and detailed; the use and implementation of the donation; Establish and improve the supervision and management mechanism of all parties and clarify the responsibilities of all parties.
