【摘要】:從20世紀90年代以來,每年因為官員貪污腐敗所造成的經濟損失十分巨大,大約是處在9875億——12570億元人民幣之間,這么龐大的數(shù)字我們很難想象到底有多少,如果按照GDP比例來計算的話,大約是占據(jù)GDP的13.2%到16.8%。①最近幾年,高層官員的落馬,讓我們看清楚了一個個所謂為人民服務的政治領導是如何一步步墮落的,更看到了解決腐敗問題的緊迫性。胡錦濤總書記曾強調:堅決預防和懲治腐敗,關系到黨的生死存亡和民心向背,是黨要一直抓的主要任務。腐敗是經濟建設的蛀蟲,是社會穩(wěn)定的天敵,危害到人民的利益和改革開放以來取得的成果。 “一個人手中越掌握大權,就越不希望有人限制他這種權力”,權力具有不受拘束和控制的特征,一旦沒有收到約束就很容易被濫用,產生腐敗問題。官員財產申報制度能夠從源頭上預防腐敗現(xiàn)象的產生,是“權錢交易”的防火墻,它能夠曝光官員領導者非法取得的財產,更能保護他們合法取得的正當財產,真正的使他們利用手中的權力為百姓謀福利。為了塑造廉政高效的政府,解決目前社會上存在的貪腐問題,本文從四個章節(jié)來具體介紹官員財產申報制度,具體的表現(xiàn)如下: 第一章主要對官員財產申報制度做個一個簡要的概述,本章第一節(jié)主要是參照許多專家學者的文章,歸納概括財產申報制度的具體定義。第二節(jié)主要是簡單的敘述一下財產申報的產生發(fā)展歷史。第三節(jié)從四個方面歸納出官員財產申報制度的法律基礎,為了該制度的貫徹實施做好鋪墊。第四節(jié)主要分析了財產申報制度所具有的特殊功能,使得我國需要貫徹落實。 第二章主要是將幾個主要國家的財產申報制度進行了系統(tǒng)的比較,通過比較才能發(fā)現(xiàn)我國財產申報制度存在的具體不足之處,為下文的立法做了鋪墊。第一節(jié)主要是介紹了我國兩個《規(guī)定》對財產申報制度的具體規(guī)定和此制度在我國的基層實踐。第二節(jié)主要是對國外的幾個國家的典型制度作了一個比較,通過美國、韓國、日本和新加坡的比較,發(fā)現(xiàn)我國官員財產申報制度與其他國家存在的差距,為第三章的立法作了鋪墊。 第三章主要是介紹我國官員財產申報制度法制化,法制化就是將財產申報制度上升到法制的層面,通過法定程序來制定和保障。第一節(jié)主要是分析將財產申報制度立法的必要性,主要從財產申報制度自身具有的優(yōu)越性和我國同發(fā)達國家合作的需要這兩個方面來闡述。第二節(jié)再前面兩節(jié)的基礎上重點了提出了如何規(guī)制財產申報制度才能更好的適合我國的國情,更細致化和具體化。 第四章主要是介紹官員財產申報制度在我國的實施,第一節(jié)是介紹行政機關如何執(zhí)行官員財產申報法,第二節(jié)是介紹司法機關如何公正適用官員財產申報法,第三節(jié)主要介紹了多元的配套措施,,配套制度的完善能更好的保證財產申報制度的實施。
[Abstract]:Since 1990s, the annual economic losses caused by corruption and corruption among officials have been very large, about 987.5 billion to one trillion two hundred and fifty-seven billion yuan. It is difficult to imagine how many such huge numbers are. If calculated according to the GDP ratio, it is about 13.2% to 16.8.1% of GDP in recent years, the downfall of senior officials, let us see clearly how the so-called political leaders who serve the people fall step by step. He also saw the urgency of solving the problem of corruption. General Secretary Hu Jintao once stressed that resolutely preventing and punishing corruption is related to the survival of the party and the people's will, and is the main task the party has to grasp all the time. Corruption is a borer of economic construction. It is the natural enemy of social stability, endangering the interests of the people and the achievements made since the reform and opening up. "the more powerful a person is, the less he wants to be restricted", which is characterized by unfettered and controlled power, which is easily abused once it is not subject to restraint. The official property declaration system can prevent corruption from occurring at the source. It is a firewall for "power and money trading." it can expose the property illegally obtained by officials' leaders, and it can better protect the legitimate property they have legally obtained. In order to shape a clean and efficient government and solve the problem of corruption in the current society, this paper introduces the property declaration system of officials from four chapters, the specific performance is as follows:. The first chapter mainly gives a brief overview of the property declaration system of officials. The first section of this chapter mainly refers to the articles of many experts and scholars. The second section is mainly a brief description of the history of property declaration. Section III summarizes the legal basis of the property declaration system of officials from four aspects. Section 4th mainly analyzes the special function of the property declaration system, which makes our country need to carry out it. The second chapter mainly compares the property declaration system of several major countries, through which we can find out the concrete deficiency of property declaration system in our country. The first section mainly introduces the specific provisions of the property declaration system and the basic practice of this system in our country. The second section is mainly the typical of several countries abroad. The system makes a comparison. Through the comparison among the United States, South Korea, Japan and Singapore, we find the gap between the property declaration system of our country and other countries, which paves the way for the legislation of Chapter three. The third chapter mainly introduces the legalization of the property declaration system of officials in China, which is to raise the property declaration system to the level of the legal system. The first section mainly analyzes the necessity of legislating the property declaration system. Mainly from the property declaration system itself has the superiority and our country and the developed country cooperation needs these two aspects to expound. The second section and the previous two sections foundation has proposed how to regulate the property declaration system to be able to be more. Well suited to the national conditions of our country, Be more detailed and concrete. Chapter 4th mainly introduces the implementation of the official property declaration system in China. The first section introduces how the administrative organs enforce the official property declaration law, and the second section introduces how the judiciary applies the official property declaration law impartially. The third section mainly introduces the multiple supporting measures, the perfect supporting system can better ensure the implementation of the property declaration system.
