我國農(nóng)業(yè)保險(xiǎn)定價(jià)法律制度研究

【摘要】:農(nóng)業(yè)保險(xiǎn)價(jià)格難題是導(dǎo)致農(nóng)業(yè)保險(xiǎn)發(fā)展受阻的主要原因之一,過高的費(fèi)率需求方負(fù)擔(dān)不起,,過低的費(fèi)率供給方無能力供給,而農(nóng)業(yè)保險(xiǎn)的準(zhǔn)公共物品屬性為政府干預(yù)農(nóng)業(yè)保險(xiǎn)市場(chǎng)提供了必要性。市場(chǎng)主體按照市場(chǎng)機(jī)制提供農(nóng)業(yè)保險(xiǎn)產(chǎn)品,政府對(duì)農(nóng)業(yè)保險(xiǎn)價(jià)格進(jìn)行補(bǔ)貼,價(jià)格的確定一方面決定了政府對(duì)農(nóng)業(yè)保險(xiǎn)的資金支持力度,一方面也決定了市場(chǎng)主體經(jīng)濟(jì)利潤額度,農(nóng)業(yè)保險(xiǎn)的價(jià)格成為政府和市場(chǎng)雙方利益實(shí)現(xiàn)的核心。根據(jù)權(quán)利義務(wù)一致的原則要求,享受政府補(bǔ)貼的農(nóng)業(yè)保險(xiǎn)定價(jià)權(quán)不可能完全將政府排除在外;再者政府作為公共事業(yè)的管理者,其對(duì)來自于公民財(cái)產(chǎn)轉(zhuǎn)移的資金使用必須以促進(jìn)公共福利,提供公共服務(wù)為前提,這一點(diǎn)也為政府應(yīng)當(dāng)在農(nóng)業(yè)保險(xiǎn)定價(jià)權(quán)中占有一席之地提供了理論支撐;最后,農(nóng)業(yè)保險(xiǎn)價(jià)格的復(fù)雜性尤其是風(fēng)險(xiǎn)區(qū)劃工作所涉及的地域之廣,數(shù)據(jù)之多,只能依靠政府強(qiáng)大信息組織能力方能完成。而農(nóng)業(yè)保險(xiǎn)市場(chǎng)化的運(yùn)作、農(nóng)業(yè)保險(xiǎn)人的自主營業(yè)權(quán)以及主要賠付責(zé)任的承擔(dān)使定價(jià)權(quán)自然而然也具有市場(chǎng)權(quán)利的屬性。為保障農(nóng)業(yè)保險(xiǎn)定價(jià)的科學(xué)性以及效率性,讓市場(chǎng)主導(dǎo)定價(jià)權(quán),給予政府部分話語權(quán)的定價(jià)權(quán)歸屬模式便成為必然選擇。公平制定農(nóng)業(yè)保險(xiǎn)價(jià)格,要遵循費(fèi)率與風(fēng)險(xiǎn)相適應(yīng)原則和各方可負(fù)擔(dān)原則。為了按照這兩個(gè)原則科學(xué)厘定費(fèi)率,風(fēng)險(xiǎn)區(qū)劃工作必不可少!掇r(nóng)業(yè)保險(xiǎn)條例》作為《農(nóng)業(yè)保險(xiǎn)法》的過渡,欠缺規(guī)制政府公權(quán)力影響農(nóng)業(yè)保險(xiǎn)定價(jià)的具體法律制度。通過對(duì)定價(jià)權(quán)主體的立法授權(quán)、價(jià)格聽證制度以及價(jià)格的公布等程序性規(guī)范有效限制公權(quán)力在農(nóng)業(yè)保險(xiǎn)價(jià)格中的濫用。除了程序性規(guī)范限制之外,一套獨(dú)立的監(jiān)管機(jī)制也十分必要。通過追責(zé)處理監(jiān)管發(fā)現(xiàn)的問題是保障定價(jià)權(quán)公平行使的最后一道屏障。
[Abstract]:The price of agricultural insurance problem is one of the main reasons leading to the development of agricultural insurance is too high, the rate of demand side can not afford, the low rate of supply ability and supply of quasi public goods attribute of agricultural insurance provides a necessity for government intervention in the agricultural insurance market. The main body of the market to provide agricultural insurance products in accordance with the market mechanism, government subsidies for agricultural insurance price, the price determined hand decided the government financial support for agricultural insurance, on the one hand also determines the market economic profit margin, the price of agricultural insurance for the core interests of both the government and the market. The fair price, should follow the principle of adaptation rate and risk and the parties burden principle. In accordance with the two principles of Science The premium rate and risk zoning work is essential. The agricultural insurance Ordinance as "transition agricultural insurance law", the lack of government regulation of public power affect the agricultural insurance pricing legal system. Based on the main pricing legislative authorization, the abuse of price hearing system and price announced the procedural norms of effectively restricting public power in agricultural insurance price in addition to the procedural norms.
