【摘要】：我國多部法律對于公民在突發(fā)事件中的信息傳播問題作出明確規(guī)定。這些法律規(guī)定在對公民編造、傳播虛假信息的追責等方面高度一致,且規(guī)定了明確的法律責任與后果,但在"信息報告"與"信息舉報、檢舉和監(jiān)督"的性質(zhì)上表述不一,出現(xiàn)了權(quán)利與義務(wù)迥異的現(xiàn)象。對于公民過失傳播突發(fā)事件失實信息的追責原則,應(yīng)嚴格遵循厘清事實、區(qū)分傳播者權(quán)能、保持法律的謙抑性等原則,同時應(yīng)將公民的信息報告納入道德責任范疇,避免在司法實踐中出現(xiàn)法律義務(wù)與法律責任嚴重失衡的情形。
[Abstract]:China's laws for the problem of information communication in the event of citizens to make specific provisions. These provisions of the law on civil fictions, dissemination of false information and other aspects of accountability is highly consistent, and the provisions of legal liability and the consequences of clear, but in the "information" and "information reporting, the nature of prosecution and supervision" the expression of a the rights and obligations of different phenomena. For the citizens of fault propagation emergency untrue information of responsibility principle, should strictly follow the clear facts, distinguish the disseminator of power, maintain modesty principle of law, and should report the information of citizens into the moral responsibility category, avoid legal obligations and legal the responsibility of serious imbalance happened in the judicial practice.
