中國(guó)城市管理綜合執(zhí)法主體規(guī)范化研究

【摘要】:多年來(lái),城市化是我國(guó)乃至全世界發(fā)展的一個(gè)必然趨勢(shì),我國(guó)的城市管理工作也成為了我國(guó)城市化工作的重要問(wèn)題之一。城市管理綜合執(zhí)法是城市發(fā)展的重要環(huán)節(jié)。在現(xiàn)階段,我國(guó)有關(guān)的法律法規(guī)對(duì)城市管理綜合執(zhí)法中行政主體的職責(zé)和權(quán)利未加以明確界定,這就導(dǎo)致了在現(xiàn)實(shí)的執(zhí)法過(guò)程中,產(chǎn)生越權(quán)執(zhí)法、多頭執(zhí)法、職權(quán)交叉與重疊、執(zhí)法活動(dòng)混亂無(wú)序等現(xiàn)象。 本文探討城市管理綜合執(zhí)法主體的作用、職權(quán)問(wèn)題,明確其權(quán)限范圍,提高其法制化水平,才能不斷提高行政執(zhí)法的質(zhì)量,更好的發(fā)揮城管職能,防止城市管理綜合執(zhí)法權(quán)的濫用,實(shí)現(xiàn)依法行政。 全文分為緒論、正文、結(jié)語(yǔ)三個(gè)部分。正文由五大部分,分別從理論基礎(chǔ),現(xiàn)實(shí)情況,原因分析,他山之石,未來(lái)路徑著手,系統(tǒng)總結(jié)分析。 第一部分從城市管理綜合執(zhí)法行政主體的相關(guān)概念及理論分析著手,闡述城市管理綜合執(zhí)法是促進(jìn)政府依法管理城市的重要手段和必要環(huán)節(jié),是充分保障城市健康、有序運(yùn)行的方式之一,能夠高效、便捷的實(shí)現(xiàn)對(duì)城市的綜合管理,最終實(shí)現(xiàn)城市整體管理水平的提升; 第二部分從我國(guó)城市管理綜合執(zhí)法主體混亂的主要表現(xiàn)出發(fā),通過(guò)總結(jié),系統(tǒng)提出目前我國(guó)城市管理綜合執(zhí)法過(guò)程中出現(xiàn)的問(wèn)題。主要有:城市管理綜合執(zhí)法主體地位不明確、綜合執(zhí)法機(jī)構(gòu)與相關(guān)職能部門(mén)的職責(zé)劃分不夠合理、城市管理綜合執(zhí)法隊(duì)伍建設(shè)有待加強(qiáng); 第三部分是我國(guó)城市管理綜合執(zhí)法主體混亂的成因分析,這些原因包括:立法未明確規(guī)定城市管理綜合執(zhí)法的主體地位,部門(mén)之間缺乏有效協(xié)作溝通機(jī)制,,城市管理本身的復(fù)雜性,社會(huì)經(jīng)濟(jì)狀況的制約,以往改革的慣性; 第四部分是國(guó)內(nèi)外城市管理執(zhí)法主體規(guī)范化的經(jīng)驗(yàn)與借鑒,從國(guó)外經(jīng)驗(yàn)來(lái)分析自身問(wèn)題,探索未來(lái)出路; 第五部分是尋找我國(guó)城市管理綜合執(zhí)法主體規(guī)范化的路徑選擇,提出建議,探索城市管理綜合執(zhí)法的未來(lái)發(fā)展之路。一是明確城市管理綜合執(zhí)法主體的法律地位;二是規(guī)范城市管理綜合行政執(zhí)法主體的組織建構(gòu);三是厘清城管綜合行政執(zhí)法的職責(zé)范圍;四是創(chuàng)建部門(mén)間的溝通協(xié)調(diào)機(jī)制;五是建立規(guī)范化得管理體系,夯實(shí)城市管理綜合執(zhí)法隊(duì)伍正規(guī)化基礎(chǔ)。
[Abstract]:For many years, urbanization has been an inevitable trend in the development of our country and the whole world, and the urban management in our country has also become one of the important problems in the urbanization work of our country. The comprehensive law enforcement of urban management is an important link in the urban development. The relevant laws and regulations of our country do not clearly define the duties and rights of the administrative subject in the comprehensive law enforcement of urban management, which leads to the emergence of ultra vires law enforcement, multiple law enforcement, overlapping and overlapping of functions and powers in the actual law enforcement process. Law enforcement activities chaos disorder and other phenomena. This paper probes into the role and authority of the subject of comprehensive law enforcement of urban management, clarifies the scope of its jurisdiction and raises its legal level, so that the quality of administrative law enforcement can be continuously improved and the function of urban management can be better brought into play. To prevent the abuse of the comprehensive law enforcement power of urban management and to realize the administration according to law. The text is divided into three parts: introduction, text and conclusion. The text is divided into five parts, which are theoretical basis, reality, reason analysis, stone of other mountains, future path, and systematic summary and analysis. The first part starts with the related concepts and theories of the administrative subject of comprehensive law enforcement of urban management, and expounds that comprehensive law enforcement of urban management is an important means and necessary link to promote the government to manage the city according to law, and is to fully protect the health of the city. One of the ways of orderly operation can realize the comprehensive management of the city efficiently and conveniently, and finally realize the promotion of the overall management level of the city; The second part starts from the main manifestation of the confusion of the main body of comprehensive law enforcement of urban management in our country, through summing up, The problems in the process of comprehensive law enforcement of urban management in China are put forward systematically. The main problems are: the status of the main body of comprehensive law enforcement in urban management is not clear, the division of responsibilities between the comprehensive law enforcement agencies and relevant functional departments is not reasonable, The construction of comprehensive law enforcement team of urban management needs to be strengthened; The third part is an analysis of the causes of confusion in the subject of comprehensive law enforcement of urban management in China. These reasons include: the legislation has not clearly stipulated the status of the subject of comprehensive law enforcement of urban management, and there is a lack of effective coordination and communication mechanism among the departments. The complexity of urban management itself, the constraints of social and economic conditions, the inertia of the past reform; Part 4th is the experience and reference of the standardization of the subject of urban management law enforcement at home and abroad, from the experience of foreign countries to analyze their own problems, explore the way out in the future; Part 5th is to find out the way to standardize the subject of urban management comprehensive law enforcement in our country, put forward some suggestions, and explore the way of the future development of urban management comprehensive law enforcement. One is to make clear the legal status of the main body of urban management comprehensive law enforcement; The second is to standardize the organization and construction of the main body of comprehensive administrative law enforcement of urban management; the third is to clarify the scope of responsibilities of the comprehensive administrative law enforcement of urban management; the fourth is to establish a communication and coordination mechanism among departments; and the fifth is to establish a standardized management system.
