【摘要】：近幾年來，食品安全問題屢次進入人們的視線中。百姓對此不安，學(xué)者各抒己見，政府也針對其實施了一系列措施。這些措施雖有成效，，但成效有限。本文認為，食品安全問題產(chǎn)生的一個重要原因是監(jiān)管部門權(quán)責(zé)不明、權(quán)重責(zé)輕。為了改善食品安全問題，監(jiān)管部門的權(quán)責(zé)如何分配是繞不過的一個難題。行政問責(zé)制就是針對權(quán)責(zé)分配的一項制度。它的目的在于使權(quán)責(zé)對等，它的功能在于事后的懲罰，也在于事前的防范和事中的監(jiān)督。 本文對食品安全監(jiān)管行政問責(zé)的研究分為四個章節(jié)。第一章闡述了“食品安全監(jiān)管”和“行政問責(zé)”兩個基本概念，對比了其他學(xué)者的概念定義，并界定了它們在本文中的定義。同時按照問責(zé)主體的不同分別介紹了這些問責(zé)主體進行問責(zé)的方式。第二章通過兩個角度說明了食品安全監(jiān)管行政問責(zé)的重要性和必要性。一個是從現(xiàn)實的角度出發(fā)，食品安全監(jiān)管本身存在一些問題，為了克服這些問題，需要行政問責(zé)；另一個是從理論的角度出發(fā)，通過行政權(quán)的委托性、行政主體的雙重身份性、權(quán)責(zé)的相關(guān)性以及權(quán)責(zé)的相反性來說明食品安全監(jiān)管行政問責(zé)的重要性和必要性。第三章分析了我國食品安全監(jiān)管行政問責(zé)實踐中存在的問題。第四章根據(jù)第三章的分析結(jié)果提出了一些完善我國食品安全監(jiān)管行政問責(zé)制的建議。
[Abstract]:In recent years, the issue of food safety has repeatedly come into the attention of people. People are uneasy about it. Scholars have expressed their own views, and the government has also implemented a series of measures against it. Although these measures have been effective, the results are limited. One of the important reasons for the food safety problem is that the authority and responsibility of the regulatory department are not clear and the weight and responsibility are light. In order to improve the food safety problem, The administrative accountability system is a system for the allocation of powers and responsibilities. Its purpose is to make the powers and responsibilities equal, and its function is to punish afterwards. It also lies in the precaution in advance and the supervision in the matter. The research on administrative accountability of food safety supervision is divided into four chapters. The first chapter expounds the two basic concepts of "food safety supervision" and "administrative accountability", and compares the definitions of other scholars. At the same time, according to the different accountability subjects, this paper introduces the ways of these accountability subjects. Chapter two illustrates the importance of administrative accountability in food safety supervision from two angles. And necessity. One is from a realistic point of view, There are some problems in food safety supervision itself. In order to overcome these problems, administrative accountability is required. Another is the dual identity of administrative subjects through the entrustment of administrative power from a theoretical point of view. The relevance of authority and responsibility and the opposite of authority and responsibility to explain the importance and necessity of administrative accountability of food safety supervision. Chapter three analyzes the problems existing in the practice of administrative accountability of food safety supervision in china. Chapter 4th according to the third chapter. The results of the chapter put forward some suggestions to improve the administrative accountability system of food safety supervision in China.
