勞動法社會實施模式的理論建構及路徑選擇

【摘要】:從實施機制的角度看,我國勞動法實施不力的困局在于對國家實施機制的過度依賴。社會實施模式具有自身的優(yōu)勢,能夠彌補國家機制的缺陷。其體系結構主要包括以多元社會組織為核心的實施主體及其實施方式,以社會權力為后盾的保障手段。其實效性離不開成熟自主的公民社會、有效的法權保障和昌達的公共理性精神的支撐。應從社會本位勞動法治模式的建構、相關社會組織制度法規(guī)的完善、工會維權能力的制度化塑造、企業(yè)社會責任運動的法制化培育等方面,建構我國的勞動法社會實施模式。
[Abstract]:From the point of view of implementation mechanism, the difficulty of ineffective enforcement of labor law in our country lies in the excessive dependence on the national implementation mechanism, and the social implementation mode has its own advantages. It can make up for the defects of the national mechanism. Its system structure mainly includes the implementation subject and the implementation method with the multiple social organization as the core, the safeguard means with the social power as the backing, and its actual effect cannot leave the mature independent civil society. The effective legal right protection and the public rational spirit of Changda should be supported by the construction of the social standard labor law governance model, the perfection of the relevant social organization system and regulations, and the institutionalization of the trade union's ability to safeguard the rights. In the aspect of legal cultivation of corporate social responsibility movement, this paper constructs the social implementation mode of labor law in our country.
