【摘要】：政府信息公開是保障公民知情權(quán)的應(yīng)有之義和重要體現(xiàn),也是現(xiàn)代政府的一項基本義務(wù)�！墩畔⒐_條例》第十三條中關(guān)于"三需要"的規(guī)定引起了學(xué)界關(guān)于申請主體資格的爭議與討論。申請信息公開的主體,根據(jù)"三需要"條款的規(guī)定,被限制在與生產(chǎn)、生活、科研有關(guān)的范圍內(nèi)。通過對制度建設(shè)的理論分析,以及世界各國政府信息公開立法經(jīng)驗的比較研究,"三需要"不應(yīng)成為對申請主體資格的限制,至多是說明理由的需要,從而提出完善我國政府信息公開申請主體資格制度的發(fā)展路徑。
[Abstract]:The publicity of government information is the proper meaning and important embodiment of protecting citizens' right to know. It is also a basic obligation of the modern government. The provision of "three needs" in Article 13th of the regulations on the publicity of Government Information has aroused controversy and discussion in academic circles about the qualifications of the applicants. According to the provisions of the "three needs" clause, it is limited to the scope related to production, life and scientific research. Through the theoretical analysis of the construction of the system, As well as the comparative study of the legislative experience of the governments in various countries in the world, "three needs" should not be a restriction on the qualifications of the applicants, but at most the need to explain the reasons. Thus, the development path of the qualification system of government information disclosure application in China is put forward.
