【摘要】：大數(shù)據(jù)是一種新的信息數(shù)據(jù)處理模式,經(jīng)過模式的處理使數(shù)據(jù)更具有洞察發(fā)現(xiàn)力,使人們更容易透過數(shù)據(jù)看到事物的本質(zhì)特征,它是一種具有較高增長率、形式種類多樣化的海量的信息資產(chǎn)。大數(shù)據(jù)在環(huán)境污染防治領(lǐng)域的應(yīng)用是將大數(shù)據(jù)技術(shù)應(yīng)用于環(huán)境污染防治領(lǐng)域當(dāng)中,通過對環(huán)境污染數(shù)據(jù)的采集、整合、存儲、分析處理,將這一分析結(jié)果應(yīng)用于環(huán)境污染的預(yù)防和治理當(dāng)中。2015年8月國務(wù)院發(fā)布了《促進(jìn)大數(shù)據(jù)發(fā)展行動綱要》(1),將大數(shù)據(jù)作為一項戰(zhàn)略來強化落實。緊接著環(huán)保部又發(fā)布了《生態(tài)環(huán)境大數(shù)據(jù)建設(shè)》(2),促進(jìn)大數(shù)據(jù)在生態(tài)資源和環(huán)境保護(hù)領(lǐng)域的應(yīng)用。大數(shù)據(jù)在環(huán)境污染防治領(lǐng)域的應(yīng)用有利于促進(jìn)環(huán)境污染預(yù)防、預(yù)警的準(zhǔn)確性;推進(jìn)環(huán)境污染治理決策的科學(xué)性;創(chuàng)新環(huán)境監(jiān)管手段,提高環(huán)境監(jiān)管的實時性;增強環(huán)境事故應(yīng)急預(yù)防和決策的有效性。隨著“十二五”規(guī)劃的圓滿收官和“十三五”規(guī)劃的崛起,環(huán)境保護(hù)信息化建設(shè)有了初步進(jìn)展,基本完成了數(shù)據(jù)整合,但環(huán)保大數(shù)據(jù)建設(shè)才剛剛起步,大數(shù)據(jù)技術(shù)應(yīng)用還任重而道遠(yuǎn)。本文借助大數(shù)據(jù)和環(huán)境法律的相關(guān)理論,探討大數(shù)據(jù)在我國環(huán)境污染防治領(lǐng)域應(yīng)用中可能存在的法律問題,同時借鑒美國環(huán)保大數(shù)據(jù)的應(yīng)用經(jīng)驗,提出一些相關(guān)法律建議。文章具體內(nèi)容分為以下四章:第一章是環(huán)境污染防治大數(shù)據(jù)應(yīng)用現(xiàn)狀分析。這一章首先指出大數(shù)據(jù)的產(chǎn)生的背景,闡述大數(shù)據(jù)的概念及其特征。接著引出本文要研究的環(huán)境污染防治大數(shù)據(jù),闡述環(huán)境大數(shù)據(jù)的概念、特征。指出大數(shù)據(jù)在環(huán)境污染防治應(yīng)用中的意義和在減少環(huán)境污染預(yù)防和治理成本,提高防治精確性的積極效用。第二章是大數(shù)據(jù)在環(huán)境污染防治應(yīng)用中的法律問題。這一章首先會對產(chǎn)生的法律問題進(jìn)行分析,主要從數(shù)據(jù)的法律屬性、數(shù)據(jù)權(quán)屬問題,數(shù)據(jù)信息安全問題、數(shù)據(jù)輸出質(zhì)量問題、數(shù)據(jù)的機械性問題進(jìn)行闡述。其次是對大數(shù)據(jù)在環(huán)境污染防治應(yīng)用中的主體責(zé)任問題進(jìn)行分析,闡明政府、環(huán)境保護(hù)行政機關(guān)、企事業(yè)單位、公民在環(huán)境污染防治大數(shù)據(jù)應(yīng)用的責(zé)任承擔(dān)。最后,對公眾參與對環(huán)境污染防治大數(shù)據(jù)應(yīng)用的影響進(jìn)行分析。第三章是美國環(huán)境污染防治大數(shù)據(jù)比較。主要是對美國環(huán)境大數(shù)據(jù)進(jìn)行分析,總結(jié)相關(guān)經(jīng)驗,同時與我國進(jìn)行比較,指出我國的不足之處予以經(jīng)驗借鑒。第四章是我國環(huán)境污染防治大數(shù)據(jù)應(yīng)用的完善建議。主要是通過總結(jié)我國大數(shù)據(jù)應(yīng)用中存在的主要問題,同時借鑒美國的有益經(jīng)驗,對環(huán)境污染防治的大數(shù)據(jù)應(yīng)用提出相關(guān)立法建議,建立專門的環(huán)境數(shù)據(jù)庫,建議建立環(huán)境污染防治大數(shù)據(jù)應(yīng)用相關(guān)法律規(guī)范,統(tǒng)一數(shù)據(jù)輸出標(biāo)準(zhǔn);保護(hù)數(shù)據(jù)信息安全;完善我國環(huán)境污染防治大數(shù)據(jù)應(yīng)用中的監(jiān)督;明確數(shù)據(jù)權(quán)屬;加強環(huán)境污染防治大數(shù)據(jù)應(yīng)用的公眾參與等完善建議。
[Abstract]:Big data is a new information data processing mode, which makes the data more insightful and discoverable, and makes it easier for people to see the essential characteristics of things through the data. It is a kind of high growth rate. Big data's application in the field of environmental pollution prevention and control is the application of big data technology in the field of environmental pollution prevention and control, through the collection, integration, storage, analysis and processing of environmental pollution data. In August 2015, the State Council issued the "platform for Action for the Development of big data" to strengthen its implementation as a strategy, followed by the Ministry of Environmental Protection. The construction of "ecological environment big data" has been promoted in order to promote the application of big data in the field of ecological resources and environmental protection. The application of big data in the field of prevention and control of environmental pollution is conducive to promoting the prevention of environmental pollution. The accuracy of early warning, the scientific nature of environmental pollution control decision, the innovation of environmental supervision means and the improvement of real-time environment supervision; Enhance the effectiveness of emergency prevention and decision-making of environmental accidents. With the successful conclusion of the 12th Five-Year Plan and the rise of the 13th Five-Year Plan, the information construction of environmental protection has made initial progress and data integration has basically been completed. However, the construction of environmental protection big data has just started, and the application of big data technology has a long way to go. This paper, with the help of big data and the relevant theories of environmental law, discusses the legal problems that may exist in the field of environmental pollution prevention and control in China. At the same time, drawing lessons from the application experience of the United States Environmental Protection big data, Some relevant legal suggestions are put forward. The specific contents of the article are divided into four chapters: the first chapter is the analysis of the current situation of the application of big data in the prevention and control of environmental pollution. This chapter first points out the background of the emergence of big data. This paper expounds the concept and characteristics of big data. Then, it introduces the concept of environmental pollution prevention and control big data, which is to be studied in this paper, and expounds the concept of environmental big data. Characteristics. Points out the significance of big data in the application of environmental pollution prevention and control and the cost reduction of environmental pollution prevention and treatment. The second chapter is the legal problems in the application of big data in the prevention and control of environmental pollution. This chapter will first analyze the legal problems arising, mainly from the legal attributes of data and the issue of data ownership. The problems of data information security, the quality of data output, the mechanical nature of data are expounded. Secondly, the principal responsibility of big data in the application of environmental pollution prevention and control is analyzed, and the government and environmental protection administrative organs are clarified. Enterprises, institutions, and citizens are responsible for the application of big data in the prevention and control of environmental pollution. Finally, This paper analyzes the impact of public participation on the application of big data in the prevention of environmental pollution. The third chapter is about the comparison of US environmental pollution prevention and control with big data. It is mainly about the analysis of American environmental big data, the summary of relevant experience, and the comparison with our country at the same time. It is pointed out that the deficiency of our country should be used for reference. Chapter 4th is the perfect suggestion for the application of big data in the prevention of environmental pollution in our country. It is mainly through summing up the main problems existing in the application of big data in our country, and at the same time learning from the beneficial experience of the United States. This paper puts forward some legislative suggestions on the application of big data in environmental pollution prevention, establishes a special environmental database, and proposes to establish relevant legal norms for environmental pollution prevention and control, to unify the standard of data output, to protect the security of data and information, and to set up relevant laws and regulations for the prevention of environmental pollution. To perfect the supervision of big data's application of environmental pollution prevention in China; to define the data ownership; to strengthen the public participation in the application of the environmental pollution prevention and control big data, and so on.
