【摘要】：運用文獻資料法等,梳理中央和省級政府退役運動員安置的政策法規(guī)文件,分析了現(xiàn)有政策法規(guī)的不足,闡述了出臺《退役運動員安置條例》的必要性、可行性及立法原則,構(gòu)建了以6章近50個條款為脈絡(luò)的條例框架。研究認(rèn)為:法治體育是依法治國的重要體現(xiàn),也是我國競技體育事業(yè)可持續(xù)發(fā)展的重要保障和必由之路;必須以法的高度保障退役運動員的生存權(quán)和勞動就業(yè)權(quán),這是國家意志對退役運動員私權(quán)利保障的重要體現(xiàn)。
[Abstract]:By using the method of literature and materials, this paper combs the policies and regulations of the central and provincial governments on the placement of retired athletes, analyzes on the shortcomings of the existing policies and regulations, and expounds the necessity, feasibility and legislative principles of the introduction of the regulations on the Placement of retired athletes. This paper constructs a framework of regulations based on nearly 50 articles in 6 chapters. The study holds that: sports ruled by law is an important embodiment of governing the country by law, and is also an important guarantee and only way for the sustainable development of competitive sports in our country; The survival and employment rights of retired athletes must be guaranteed by the law, which is an important embodiment of the national will to guarantee the private rights of retired athletes.
