【摘要】：行政處罰是行政機(jī)關(guān)管理社會(huì)生活的最重要手段之一,處罰類案件也始終占據(jù)各類行政案件數(shù)量的首位。研究行政處罰類案件裁判,為研判行政處罰實(shí)踐及依法行政之現(xiàn)狀,提供了有益樣本。從司法審查結(jié)果的數(shù)據(jù)分析來看,處罰類案件有其自身特點(diǎn),值得關(guān)注。從案件裁判中也發(fā)現(xiàn),一些疑難問題仍亟待明確。如:行政處罰的識(shí)別方法;行政處罰中行為、種類與幅度的解釋方法;下位法"設(shè)定"與"規(guī)定"的權(quán)限;負(fù)責(zé)人集體討論決定的范圍;違法所得的確定標(biāo)準(zhǔn);行政處罰與政府信息公開的銜接;相對(duì)人知情權(quán)的保障等等。實(shí)踐問題總具有別樣的生命力,本文提出上述實(shí)踐問題,以待理論上的進(jìn)一步廓清和立法適時(shí)的歸納、總結(jié)與回應(yīng),循此,行政法亦得以不斷發(fā)展。
[Abstract]:Administrative punishment is one of the most important means for administrative organs to manage social life, and punishment cases always occupy the first place in the number of administrative cases. In order to study the practice of administrative punishment and the present situation of administration according to law, we should study the adjudication of administrative punishment cases. From the data analysis of the results of judicial review, punishment cases have their own characteristics, it is worthy of attention. From the case adjudication, we also find that some difficult problems still need to be clarified, such as: the identification method of administrative punishment; In the administrative punishment, the interpretation method of the category and the range; the authority of "setting" and "regulation" of the lower law; the scope of collective discussion and decision of the responsible person; the determination standard of the illegal income; the connection between the administrative punishment and the publicity of the government information; The protection of the relative person's right to know and so on. The practical problems always have a different vitality. This paper puts forward the above practical problems, in order to further clarify the theory and the timely induction, summary and response of the legislation, thus, the administrative law can also be continuously developed.
