論物權(quán)性耕作經(jīng)營(yíng)權(quán)之創(chuàng)設(shè)

【摘要】:在農(nóng)村土地承包經(jīng)營(yíng)權(quán)轉(zhuǎn)包、抵押、入股、信托流轉(zhuǎn)的實(shí)踐中,呈現(xiàn)出在農(nóng)村土地承包經(jīng)營(yíng)權(quán)上再次設(shè)定物權(quán)性耕作經(jīng)營(yíng)權(quán)的現(xiàn)實(shí)需要與運(yùn)行樣態(tài)。通過(guò)家庭承包方式獲得的土地承包經(jīng)營(yíng)權(quán)的相當(dāng)于所有權(quán)的屬性,為物權(quán)性耕作經(jīng)營(yíng)權(quán)創(chuàng)設(shè)奠定了權(quán)能分離與借鑒永佃權(quán)及農(nóng)育權(quán)制度的法理基礎(chǔ);物權(quán)性耕作經(jīng)營(yíng)權(quán)的創(chuàng)設(shè)符合用益物權(quán)客體設(shè)定的一般規(guī)律,也并不違背一物一權(quán)原則。因此,我國(guó)民法典的物權(quán)編應(yīng)當(dāng)對(duì)物權(quán)性耕作經(jīng)營(yíng)權(quán)的稱謂、期限、設(shè)立與變動(dòng)、權(quán)利狀態(tài)、消滅機(jī)制等基本問(wèn)題給予規(guī)定,明確耕作經(jīng)營(yíng)權(quán)人享有占有、使用、收益及對(duì)該權(quán)利進(jìn)行轉(zhuǎn)讓、抵押、租賃的權(quán)利,從而實(shí)現(xiàn)物權(quán)性耕作經(jīng)營(yíng)權(quán)的法定化。
[Abstract]:In the rural land contract management right subcontract, mortgage, equity, trust circulation practice. It presents the realistic need and operation pattern of establishing the real right of farming management again on the rural land contract management right. The property of the land contract management right obtained through the family contract way is equivalent to the ownership property. It lays a legal foundation for the establishment of the right of management of real right farming and the separation of power and reference for the system of permanent tenancy right and agricultural and reproductive right. The creation of real right of farming management conforms to the general law of object setting of usufruct right, and does not violate the principle of "one thing, one right". Therefore, the title and term of real right of real right should be included in the civil code of our country. The establishment and change, the state of the right, the elimination mechanism and other basic issues to be stipulated, clear that the owner of the right of farming and management enjoy possession, use, income and the right to transfer, mortgage, lease of the right. Thus realizing the legalization of the real right of farming management.
