我國食品安全多元規(guī)制模式研究

【摘要】:衣食住行是人們?nèi)粘I钪凶顬殛P注的話題。俗話說:民以食為天。由此可見食品的重要性,在過去的一段時間里,食品安全問題頻發(fā),這逐漸引起了世界上各個國家的重視,我國政府也日益加強對食品安全問題的監(jiān)管,然而食品安全問題實際上已經(jīng)日趨復雜,演變?yōu)榱讼盗协h(huán)節(jié)問題。 論文首先從食品安全多元規(guī)制的基礎理論為出發(fā)點,,指出了目前我國食品安全規(guī)制問題上的時代緊迫感,指出了傳統(tǒng)的單一的依靠國家或政府監(jiān)管的缺陷,在公民社會興起的時代大背景下論文提出了建立食品安全多元規(guī)制的必要性,因為無論是市場還是政府都存在著“市場失靈”、“政府失靈”,這在客觀上呼吁食品安全問題規(guī)制亟待全社會的力量參與,特別是要讓非政府組織、企業(yè)自律和消費者自發(fā)地行動起來。 其次,論文采取了比較研究的方法,通過介紹世界上發(fā)達國家的一些做法,介紹了國外發(fā)達國家的一些經(jīng)驗和做法,在充分地肯定國外發(fā)達國家食品安全規(guī)制的經(jīng)驗基礎上,指出了國外發(fā)達國家食品安全規(guī)制模式的優(yōu)點及其對我國現(xiàn)實國情的適用。 緊接著,論文采取了實證分析的方法,分析了當下我國食品安全問題規(guī)制的現(xiàn)狀,指出了迄今為止我國法律制度存在的缺陷。指出了多部門混合進行規(guī)制的混亂局面、我國食品安全的法律存在空缺、漏洞等問題,除此之外,還指出了我國目前只強調(diào)對終端監(jiān)管,反而忽視全程規(guī)制、食品安全信息機制并不健全,等等。 最后,論文主要的創(chuàng)新點和主要結論是,提出了完善我國食品安全問題規(guī)制模式的制度性的建議和對策,當然堅持政府主導不放松,除了在強化政府對食品安全問題規(guī)制的組織領導作用之外,還要發(fā)動全社會的力量,積極地參與到我國食品安全問題的規(guī)制中來,以政府為主導,依靠企業(yè)、行業(yè)協(xié)會、消費者的共同參與,嘗試性地提出了構建一種符合我國國情的食品安全多元規(guī)制模式。
[Abstract]:Food, clothing, housing and transportation are the most concerned topics in people's daily life. As the saying goes: people take food as the sky. This shows the importance of food, in the past period of time, food safety issues occur frequently. This has gradually aroused the attention of all countries in the world, and our government has increasingly strengthened the supervision of food safety. However, the food safety problem has become more and more complex and evolved into a series of problems. Starting from the basic theory of multi-regulation of food safety, the paper points out the sense of urgency in the current food safety regulation in China, and points out the defects of the traditional single supervision by the state or the government. Under the background of the rise of civil society, the paper puts forward the necessity of establishing multi-regulation of food safety, because both the market and the government have "market failure" and "government failure". This objectively calls for the participation of the whole society in the regulation of food safety issues, especially for non-governmental organizations, enterprises, self-discipline and consumers to act spontaneously. Secondly, the paper adopts the method of comparative research, introduces some practices of developed countries in the world, and introduces some experiences and practices of foreign developed countries. On the basis of fully affirming the experience of food safety regulation in foreign developed countries, this paper points out the advantages of food safety regulation model in foreign developed countries and its application to the actual situation of our country. Then, the paper adopts the method of empirical analysis to analyze the current situation of food safety regulation in China. Pointed out the defects of our legal system up to now, pointed out the confusion of multi-sector mixed regulation, the food safety law of our country has the vacancy, the loophole and so on, in addition. It also points out that our country only emphasizes the terminal supervision, but neglects the whole process regulation, the food safety information mechanism is not perfect, and so on. Finally, the main innovation and the main conclusion of the paper is to put forward some suggestions and countermeasures to perfect the regulation mode of food safety in our country, of course, to insist on the government leading and not to relax. In addition to strengthening the role of the government in the regulation of food safety, but also to mobilize the strength of the whole society, actively participate in the regulation of food safety in China, government-led, relying on enterprises. With the participation of industry associations and consumers, this paper tries to put forward a multi-regulation model of food safety in accordance with the national conditions of our country.
