【摘要】：宗教財(cái)產(chǎn)法律地位的特殊性來(lái)源于宗教活動(dòng)場(chǎng)所登記所確認(rèn)和設(shè)定的宗教性用途,該目的性用途構(gòu)成宗教財(cái)產(chǎn)的本質(zhì)性特征,直接決定了宗教財(cái)產(chǎn)在法律規(guī)制上的特性。宗教財(cái)產(chǎn)的特性只與設(shè)定其宗教性用途的登記程序相關(guān),宗教財(cái)產(chǎn)的權(quán)屬登記并未也并不承擔(dān)該項(xiàng)功能。有關(guān)宗教財(cái)產(chǎn)的糾紛,司法機(jī)關(guān)以區(qū)分是否屬于宗教團(tuán)體內(nèi)部事務(wù)管理作為是否介入的判斷標(biāo)準(zhǔn),在該標(biāo)準(zhǔn)的認(rèn)定中核心要素是審查被告是否具有與宗教團(tuán)體或者宗教財(cái)產(chǎn)管理有緊密關(guān)聯(lián)的身份和資格。
[Abstract]:Confirm the special legal status of religious property from religious activities and religious setting registration purposes, the purpose of use constitute the essential characteristics of religious property, directly determines the legal regulation of religious property in the properties. Characteristics of religious property is only related to set its religious use registration procedures, registration the religious property did not also do not bear the function. The religious property disputes, the judicial organ to distinguish whether it belongs to the management of the internal affairs of religious groups as a criterion to judge whether the intervention, in that the standard of core elements is to review whether the defendant with religious organizations or religious property management is closely related to the identity and status.
