【摘要】：我國慈善事業(yè)正在從傳統(tǒng)慈善向現(xiàn)代慈善轉(zhuǎn)型,慈善立法應(yīng)當(dāng)適應(yīng)慈善事業(yè)轉(zhuǎn)型的需要。近年來,我國部分省市相繼頒布慈善事業(yè)促進(jìn)條例或募捐條例可以視為地方對(duì)慈善事業(yè)轉(zhuǎn)型的法律回應(yīng)。地方慈善立法在慈善募捐、慈善文化、社會(huì)企業(yè)、監(jiān)督管理等方面確實(shí)有所創(chuàng)新,但是囿于立法權(quán)限,地方在慈善組織準(zhǔn)入、稅收優(yōu)惠等關(guān)鍵制度上無能為力。因此,盡快制定統(tǒng)一的慈善法對(duì)保障和促進(jìn)慈善事業(yè)的健康發(fā)展尤為迫切和必要。制定統(tǒng)一的慈善法應(yīng)當(dāng)堅(jiān)持改革創(chuàng)新、培育扶持和寬進(jìn)嚴(yán)管的基本原則,既要參考和借鑒國外的慈善立法經(jīng)驗(yàn),也要充分利用本土資源特別是地方立法資源,積極回應(yīng)慈善事業(yè)的現(xiàn)實(shí)需求,為慈善事業(yè)健康發(fā)展提供法律保障。
[Abstract]:Our charity is from the traditional to the modern transformation of charity charity, charity legislation should adapt to the need of charity transformation. In recent years, some provinces and cities in our country have been promulgated to promote philanthropy regulations or fundraising regulations can be regarded as the legal response to local charities for transformation. Fang Cishan in the legislation of charity, charity culture, social enterprises. Supervision and management does have the innovation, but because of the legislative authority, the local charity in access, tax incentives and other key system incapable of action. Therefore, the charity law enacted as soon as possible to protect and promote the healthy development of charity. Charity is urgent and necessary to formulate a unified law should adhere to reform and innovation, foster and basic principles wide into the strict control of the reference, not only to foreign charitable legislative experience, to make full use of local resources especially the local legislative resources, product In response to the real needs of philanthropy, it provides legal protection for the healthy development of charities.
