【摘要】：當(dāng)前在查辦證券內(nèi)幕交易罪案件中,普遍出現(xiàn)兩個問題:一是公安偵查環(huán)節(jié)。公安機(jī)關(guān)沒有履行主要的偵查職能,實際主要的偵查工作大多由證券監(jiān)管行政部門完成。公安機(jī)關(guān)主要的工作變成核實和轉(zhuǎn)化行政執(zhí)法機(jī)關(guān)的證據(jù);二是檢察和審判環(huán)節(jié)。對于認(rèn)定是否構(gòu)成犯罪的關(guān)鍵事實,檢察院和法院基本上放棄獨立判斷,主要依賴于證券監(jiān)管行政部門的判斷,而且在事實上又使刑事被告人對證券監(jiān)管行政部門的判斷無法進(jìn)行質(zhì)證。
[Abstract]:At present, in the investigation and handling of securities insider trading cases, there are two common problems: one is the public security investigation link. Public security organs do not perform the main investigation functions, the actual main investigation work is mostly done by the securities supervision administrative department. The main work of the public security organ becomes the verification and transformation of the evidence of the administrative law enforcement agency; the second is the procuratorial and judicial links. For the key facts of determining whether or not to constitute a crime, the procuratorate and the court basically give up independent judgment, which mainly depends on the judgment of the administrative department of securities supervision, and in fact makes the criminal defendant unable to cross-examine the judgment of the administrative department of securities supervision.
