【摘要】：網(wǎng)絡(luò)安全及其刑事保障是全球課題,《網(wǎng)絡(luò)犯罪公約》和"信息社會與刑法"決議等先后供給了有益的刑事治理經(jīng)驗(yàn),中國也積極迎頭趕上。應(yīng)加快整合實(shí)體法與程序法資源,聚焦刑法立法升級換代與刑事訴訟模式重塑,著力推動刑法與刑事訴訟的網(wǎng)絡(luò)知識轉(zhuǎn)型,協(xié)同落實(shí)具體任務(wù)清單。應(yīng)以"同呼吸、共命運(yùn)"與聯(lián)合國的主導(dǎo)地位為基本法治思維,以國際公約制定工作為當(dāng)前要務(wù),積極推動司法合作、鎖定國際公約模板、創(chuàng)新聯(lián)合國工作機(jī)制等一攬子議程的整體實(shí)現(xiàn)。
[Abstract]:Network security and its criminal security are global issues. The Convention on Cybercrime and the Resolution on the Information Society and Criminal Law have provided beneficial experience in criminal governance, and China has also actively caught up with them. It is necessary to speed up the integration of substantive and procedural law resources, focus on the upgrading of criminal law legislation and remolding the criminal procedure model, promote the network knowledge transformation of criminal law and criminal procedure, and implement the specific task list in cooperation. "one breath, common destiny" and the leading position of the United Nations should be taken as the basic thinking of the rule of law, and the international convention should be taken as the current priority, and judicial cooperation should be actively promoted, and the template of the international convention should be locked in. The overall realization of a package of agenda, such as innovating the working mechanism of the United Nations.
