【摘要】：本文通過對電信員工出售、非法提供公民個人信息案件的分析，指出案件審理過程中出現(xiàn)的爭議問題。以解決案件爭議為切入點，詳細分析了出售、非法提供公民個人信息罪的犯罪構(gòu)成要件，并且對以下幾個爭議問題進行深入研究。首先，，明確了“公民個人信息”的法律屬性及范圍，并對其提出相關(guān)完善建議；其次，在詳細介紹“情節(jié)嚴重”的基礎(chǔ)上，具體列舉出情節(jié)嚴重的衡量標(biāo)準(zhǔn)；最后，指出出售、非法提供公民個人信息罪法定刑的不足之處，在結(jié)合外國相關(guān)立法與我國司法實踐具體情況的基礎(chǔ)上提出完善法定刑配置的相關(guān)立法建議，以求達到刑法更加完善保護公民個人信息的目標(biāo)。
[Abstract]:Based on the analysis of the cases in which telecom employees sell and illegally provide citizens' personal information, this paper points out the controversial issues in the trial process of the cases.This paper analyzes in detail the constitutive elements of the crime of selling and illegally providing personal information to citizens in order to resolve the disputes in cases, and makes an in-depth study on the following several controversial issues.First of all, it clarifies the legal attribute and scope of "citizen's personal information", and puts forward the relevant consummation suggestion to it; secondly, on the basis of introducing "serious circumstances" in detail, it enumerates the measure standard of serious circumstances; finally, it points out that the sale,On the basis of combining the relevant legislation of foreign countries and the specific situation of judicial practice in our country, the author puts forward the relevant legislative suggestions to perfect the disposition of the legal punishment on the basis of the deficiency of the illegal provision of citizen's personal information crime.In order to achieve the criminal law to better protect the personal information of citizens.
