【摘要】：隨著經(jīng)濟(jì)社會(huì)的不斷發(fā)展、國(guó)家對(duì)反腐的重視性的不斷提高，以及民眾們對(duì)腐敗貪官的深?lèi)和唇^所引發(fā)的對(duì)公平正義的再次呼喚，我們不得不重新審視為什么性賄賂這種社會(huì)危害性極高的犯罪行為遲遲未能入罪。十八大報(bào)告中加強(qiáng)了黨風(fēng)廉政建設(shè)、反腐敗工作的部署，報(bào)告中還指出“要堅(jiān)持中國(guó)特色反腐倡廉道路，堅(jiān)持標(biāo)本兼治、綜合治理、懲防并舉、注重預(yù)防方針，全面推進(jìn)懲治和預(yù)防腐敗體系建設(shè)�！睆木唧w措施上來(lái)講，有以下幾點(diǎn)：“一是堅(jiān)決懲治腐敗，二是有效預(yù)防腐敗，三是深化改革，建立健全權(quán)力運(yùn)行制約和權(quán)力監(jiān)督體系，，從源頭上防治腐敗。”性賄賂應(yīng)當(dāng)盡早進(jìn)入到刑法所規(guī)范的體系中去，以免更多的犯罪分子因?yàn)榱⒎ǖ娜毕荻用摲傻闹撇谩９P者通過(guò)考察、研究、整理，認(rèn)為性賄賂應(yīng)當(dāng)立法進(jìn)行規(guī)制。去除摘要和結(jié)語(yǔ)筆者將本文分為三個(gè)章節(jié)。 第一章性賄賂的概述。在這一章里筆者通過(guò)介紹性賄賂的內(nèi)涵和性賄賂產(chǎn)生的原因分析性賄賂這一行為。性賄賂的內(nèi)涵包括性賄賂的概念（古代和現(xiàn)代）、性賄賂的各種特點(diǎn)、性賄賂的多種多樣的行為方式。而在經(jīng)濟(jì)社會(huì)發(fā)展急速的當(dāng)今社會(huì)，性賄賂的產(chǎn)生原因也是復(fù)雜的、各種各樣的，包括客觀的社會(huì)原因和犯罪分子的主觀原因兩個(gè)方面。 第二章性賄賂入罪的理論探討。該章分為三個(gè)部分，第一部分主要是闡述總結(jié)學(xué)界中對(duì)性賄賂是否入罪的爭(zhēng)議，支持的學(xué)者認(rèn)為性賄賂具有嚴(yán)重的社會(huì)危害性、更有利于賄賂罪體系的完整性、符合民眾的支持；而反對(duì)的學(xué)者認(rèn)為性賄賂違反刑法的謙抑性原則、取證困難、實(shí)際無(wú)法操作等原因。第二和三部分主要分析了入罪的可行性和應(yīng)當(dāng)行，駁斥了反對(duì)者的觀點(diǎn)，論述了性賄賂入罪符合國(guó)際趨勢(shì)、并不違反刑法謙抑性原則、性賄賂也完全符合賄賂犯罪的構(gòu)成要件、如今的現(xiàn)實(shí)緊迫性等。 第三章入罪的立法建議，分為兩個(gè)部分立法建議和量刑建議。學(xué)界中有幾個(gè)觀點(diǎn)：有的學(xué)者認(rèn)為可以在賄賂罪單獨(dú)設(shè)立一款、也可以在刑法中增設(shè)新的罪名、也可以用司法解釋進(jìn)行擴(kuò)張解釋?zhuān)歉嗟氖侵С謱ⅰ柏?cái)物”范圍擴(kuò)大為“不正當(dāng)利益”。筆者也支持最后一種將“財(cái)物”范圍擴(kuò)大為“不正當(dāng)利益”更容易操作也符合國(guó)際趨勢(shì)。并且根據(jù)立法模式和量刑情節(jié)模擬了幾種量刑方式。
[Abstract]:With the continuous development of economy and society, the state attaches great importance to anti-corruption, and the public's abhorrence of corrupt officials calls for fairness and justice again. We have to re-examine why sexual bribery, a highly harmful criminal act of society, has not been criminalized. In the report of the 18th National Congress of the Communist Party of China, we strengthened the building of a clean and honest party and the deployment of anti-corruption work. The report also pointed out that "We should adhere to the road of combating corruption and promoting clean government with Chinese characteristics, persist in treating both the symptoms and the root causes, comprehensively manage the root causes, deal with both punishment and prevention, pay attention to the policy of prevention, and comprehensively promote the construction of the system of punishing and preventing corruption." in terms of concrete measures, There are the following points: "first, resolutely punish corruption; second, effectively prevent corruption; and third, deepen reform and establish and improve the system of power operation, restriction and supervision," Prevention of corruption from the source. "sexual bribery should enter the system regulated by the criminal law as soon as possible, so as not to allow more criminals to escape the sanction of the law because of the defects of the legislation." The author thinks that sexual bribery should be regulated by legislation. The first chapter is an overview of sexual bribery. In this chapter, the author analyzes the behavior of sexual bribery by introducing the connotation of sexual bribery and the causes of sexual bribery. The connotation of sexual bribery includes the concept of sexual bribery (ancient and modern, various characteristics of sexual bribery). In today's society with rapid economic and social development, the causes of sexual bribery are complex and varied, including objective social reasons and subjective causes of criminals. This chapter is divided into three parts. The first part is to summarize the controversy of whether sexual bribery is criminalized in academic circles. The supporting scholars believe that sexual bribery has serious social harmfulness. It is more conducive to the integrity of the bribery crime system and is in line with the support of the public. However, the opposing scholars believe that sexual bribery violates the principle of modesty of the criminal law and makes it difficult to obtain evidence. The second and third parts mainly analyze the feasibility and action of incrimination, refute the viewpoint of opponents, and discuss that the criminalization of sexual bribery conforms to the international trend and does not violate the principle of modesty of criminal law. Sexual bribery is also fully in line with the elements of bribery crime, the reality of the urgency and so on. The third chapter is divided into two parts of legislative recommendations and sentencing recommendations. There are several viewpoints in the academic circle: some scholars think that a separate section can be established in the crime of bribery, or a new offence can be added to the criminal law. It can also be expanded by judicial interpretation. However, more support is given for extending the scope of "property" to "improper interest". The author also supports the last one to expand the scope of "property" to "improper interest", which is easier to operate and is in line with international trends. The model and sentencing plot simulate several sentencing methods.
