【摘要】:黨和國家一直高度重視“三農(nóng)”問題,國務院連續(xù)多年以中央一號文件的形式要求加強“三農(nóng)”建設,做好“三農(nóng)服務”,在全國各地開展新農(nóng)村運動,推動農(nóng)村新型社區(qū)建設,建設成“生產(chǎn)發(fā)展,生活寬裕,鄉(xiāng)風文明,村容整潔,管理民主”的新農(nóng)村。在農(nóng)村新型社區(qū)的建設過程之中,必將與農(nóng)村土地發(fā)生緊密聯(lián)系。如何處理好兩者的關系,利用好農(nóng)村土地,發(fā)揮土地的最大價值成為當務之急。在現(xiàn)有的法律制度框架內(nèi),我國在農(nóng)村土地的立法方面一直保持著非常謹慎的態(tài)度,過分強調(diào)農(nóng)村土地的穩(wěn)定,擔心農(nóng)村土地的流轉(zhuǎn)會動搖國家生存發(fā)展的根本。正是由于這種保守的立法思想,所以我國在土地流轉(zhuǎn)上呈現(xiàn)出比較僵化的思想,與社會主義市場經(jīng)濟是不相一致的,與農(nóng)村新型社區(qū)的建設也是相違背。 本文除去引言和結論以外,主要有四個部分:第一部分主要是分析和研究農(nóng)村新型社區(qū)建設中土地流轉(zhuǎn)的基礎性理論,為下文的展開奠定基礎。這些基礎性理論主要包括農(nóng)村新型社區(qū)理論、土地利用理論、土地發(fā)展權理論、農(nóng)村新型社區(qū)建設與土地利用兩者之間的邏輯關系。第二部分主要是分析和研究農(nóng)村新型社區(qū)建設中土地流轉(zhuǎn)存在的問題,通過文章的研究發(fā)現(xiàn),我國現(xiàn)階段在土地流轉(zhuǎn)上存在的問題主要有五個,分別是農(nóng)村土地所有權主體缺位、土地承包經(jīng)營權流轉(zhuǎn)受限、宅基地使用權流轉(zhuǎn)受限、建設用地使用權流轉(zhuǎn)受限和農(nóng)村土地規(guī)劃不足等五個問題。第三部分主要是分析和研究農(nóng)村新型社區(qū)建設中土地流轉(zhuǎn)問題的成因,通過文章的研究發(fā)現(xiàn),原因主要集中在兩個方面,首先是我國土地法律制度設計不合理,其次是政府監(jiān)管管理。第四部分主要是根據(jù)上文指出的問題,有針對性地提出發(fā)展完善的原則和對策。從完善法律制度的角度來說,這些對策主要有以下五個方面,分別是確立農(nóng)村村民的成員權,目的在于明確所有權的歸屬;加強土地承包經(jīng)營權、宅基地使用權和建設用地使用權的流轉(zhuǎn);加強農(nóng)村土地利用的規(guī)劃,落實村級規(guī)劃制度。 我國應當從國情出發(fā),從法律制度上為農(nóng)村土地利用松綁,加大農(nóng)村土地的流轉(zhuǎn)的同時,減少農(nóng)民對土地的依賴性。只有法律制度為農(nóng)地流轉(zhuǎn)松綁,才能從根本上提高土地的利用效率,才能從根本上培養(yǎng)農(nóng)村發(fā)展內(nèi)源性力量,從而能夠為農(nóng)村新型社區(qū)的建設提供更多的支持。對于農(nóng)村土地來說,主要可以分為承包經(jīng)營地、宅基地和建設用地,如何從法律制度的設計上為這三大土地提供更多被利用的機會,增進農(nóng)村地區(qū)的經(jīng)濟增長點,推動農(nóng)村新型社區(qū)的建設成為當務之
[Abstract]:The party and state have always attached great importance to the issue of "agriculture, countryside and farmers", and the State Council has for many years called for strengthening the construction of "agriculture, countryside and farmers", doing a good job of "three rural services" and carrying out a new rural movement throughout the country in the form of the first document of the Central Committee. To promote the construction of new rural communities and build a new rural area with "productive development, comfortable living, civilized style of the countryside, clean and tidy villages, democratic management", and in the course of the construction of the new type of rural communities. How to deal with the relationship between them, how to make good use of rural land and give full play to the maximum value of land has become an urgent matter. Within the framework of the existing legal system. China has always maintained a very cautious attitude in the legislation of rural land, overemphasized the stability of rural land. The third part is mainly to analyze and study the causes of land transfer in the construction of new rural communities, through the study of the paper found. The reasons mainly focus on two aspects, first, the unreasonable design of our land legal system, and secondly, the government supervision and management. Part 4th is mainly based on the problems pointed out above. From the point of view of perfecting the legal system, these countermeasures mainly have the following five aspects, which are to establish the membership rights of rural villagers.
