【摘要】：在我國現(xiàn)行的土地制度中，農(nóng)村集體在對于集體土地所有權(quán)行使中暴露出許多缺憾，直接關(guān)系到農(nóng)村經(jīng)濟(jì)是否能夠健康穩(wěn)定發(fā)展，關(guān)系到農(nóng)民的切身利益。因此，如何克服這些弊端使農(nóng)村集體土地所有權(quán)制度科學(xué)化成為制定中國民法典過程中所必須解決的重要問題之一。文章通過對現(xiàn)行集體土地所有權(quán)的亂局進(jìn)行分析，查找集體土地所有權(quán)行使中無法對抗國家公權(quán)力、為少數(shù)人所操控、無法保障農(nóng)民利益等問題的根源。并積極探索集體土地所有權(quán)的發(fā)展改革之路，以保護(hù)耕地和保障農(nóng)民利益為準(zhǔn)繩，探討如何加強(qiáng)地方政府在征用集體土地時的限制、如何做到農(nóng)村集體用地的土地用途管控以及對于農(nóng)用地、非農(nóng)建設(shè)用地及農(nóng)村宅基地各種不同用途的集體用地進(jìn)入市場流轉(zhuǎn)的制度設(shè)計。
[Abstract]:In China's current land system, the rural collective has exposed many shortcomings in the exercise of collective land ownership, which is directly related to whether the rural economy can develop healthily and steadily, and is related to the vital interests of farmers. Therefore, how to overcome these drawbacks and make the rural collective land ownership system scientifically become one of the important problems that must be solved in the process of formulating the Chinese civil code. Based on the analysis of the current mess of collective land ownership, this paper finds out the root cause of the problem that collective land ownership can not fight against the public power of the state, manipulated by a few people, and can not protect the interests of farmers. The road of reform and actively explore the development of collective land ownership, to protect arable land and protect the interests of farmers as the criterion, discusses how to strengthen the local government in the collective land expropriation, the limitation of land use control to do with and for agricultural land and non-agricultural construction land and rural residential land with a variety of different uses of the collective land into the system design of the circulation market of rural collective.
