【摘要】：作為此次刑事訴訟法修改的一大亮點,我國2012年刑事訴訟法首次規(guī)定了技術(shù)偵查措施。但是新法中有關(guān)技術(shù)偵查措施的規(guī)定包含了大量的模糊性語言。根據(jù)我國現(xiàn)階段的實際狀況,這些模糊性語言有其存在的必然性和現(xiàn)實基礎(chǔ)。然而過多的模糊性語言使法律的可操作性、穩(wěn)定性和統(tǒng)一性大打折扣,也為偵查機關(guān)濫用權(quán)力打開方便之門�；趪鴥�(nèi)外司法實踐,結(jié)合模糊語言學的相關(guān)理論,我國有必要從立法、法律解釋和程序設(shè)計三重維度,對這些模糊性語言進行限定。
[Abstract]:As a highlight of the revision of the Criminal procedure Law, China's Criminal procedure Law in 2012 for the first time stipulated technical investigation measures.However, the provisions of the new law on technical investigation measures contain a large number of vague language.According to the present situation of our country, these fuzzy languages have their inevitability and realistic basis.However, too much fuzziness makes the operation, stability and unity of the law less, and it also opens the door for the investigating organs to abuse their power.Based on the judicial practice at home and abroad and the relevant theories of fuzzy linguistics, it is necessary to limit these fuzzy languages from the three dimensions of legislation, legal interpretation and programming.
