【摘要】：金融海嘯包含了三重危機(jī):次級(jí)貸款危機(jī)、金融衍生品危機(jī)以及金融全球化危機(jī)。它們分別處于基礎(chǔ)金融環(huán)節(jié)、金融衍生品市場(chǎng)以及國(guó)際金融市場(chǎng)。三種危機(jī)之間有聯(lián)動(dòng)效應(yīng),但可以分別進(jìn)行分析。相應(yīng)地,它們對(duì)法律提出的挑戰(zhàn)也各不相同,涉及國(guó)內(nèi)法、國(guó)際法兩個(gè)層面,覆蓋金融監(jiān)管(公法)與金融商法(私法)兩類完全不同的法律領(lǐng)域。法律對(duì)金融海嘯的回應(yīng)也應(yīng)當(dāng)三條進(jìn)路并行,包括國(guó)際層面的新布雷頓森林體系建設(shè)、金融監(jiān)管立法的改進(jìn),以及目前尚為人忽略的金融商法/私法秩序的重構(gòu)。
[Abstract]:The financial tsunami contains three crises: subprime loan crisis, financial derivatives crisis and financial globalization crisis. They are in the basic financial sector, financial derivatives markets and international financial markets. There are linkage effects among the three crises, but can be analyzed separately. Accordingly, they pose different challenges to the law, involving two levels of domestic law and international law, covering two completely different areas of law: financial regulation (public law) and financial commercial law (private law). The legal response to the financial tsunami should go hand in hand, including the construction of the new Bretton Woods system at the international level, the improvement of the financial regulatory legislation, and the reconstruction of the financial and commercial / private law order, which is still neglected.
