【摘要】： 抵押權人利益保險在我國還是一個相對陌生的險種,而在西方發(fā)達國家該保險已經(jīng)有了一定程度的發(fā)展并趨于成熟,本文主要參照國外抵押權人利益保險的有關理論、國內(nèi)外有關學說以及中國《保險法》、《海商法》、《擔保法》等有關法律法規(guī),試圖對該險種作一全面的法律分析,并試圖為保險公司在不久的將來訂立抵押權人利益保險合同條款提供一些建議。 本文共分四章。第一章主要介紹了抵押權人利益保險的概念、特征與法律性質,筆者采用與一般的財產(chǎn)保險進行對比分析的方法,著重突出了抵押權人利益保險的不同之處;第二章主要介紹了在中國引進抵押權人利益保險的必要性與可行性;第三章主要通過對各學說的對比分析研究了抵押權人利益保險合同當事人的權利義務,包括抵押權人的如實告知義務與及時通知義務,抵押權人的索賠權利,保險人承保風險的范圍,保險人的代位求償權;第四章是本文的點睛之筆,主要是為保險公司引進抵押權人利益保險設立保險條款提出幾點建議。
[Abstract]:The interest insurance of mortgagee is relatively unfamiliar in our country, but it has developed to a certain extent in western developed countries. This paper mainly refers to the relevant theories of interest insurance of mortgagee in foreign countries. The relevant theories at home and abroad, as well as the relevant laws and regulations of China's "Insurance Law", "Maritime Law", "guaranty Law", and so on, attempt to make a comprehensive legal analysis of this kind of insurance. It also tries to provide some suggestions for insurance companies to conclude mortgagee interest insurance contract in the near future. This paper is divided into four chapters. The first chapter mainly introduces the concept, characteristics and legal nature of mortgagee interest insurance. The second chapter mainly introduces the necessity and feasibility of introducing mortgagee interest insurance in China. The third chapter mainly studies the rights and obligations of the mortgagee's interest insurance contract parties, including the mortgagee's truthful informing obligation and timely notification obligation, and the mortgagee's claim right. The scope of insurer's underwriting risk and the insurer's subrogation right; The fourth chapter is the finishing touch of this paper, mainly for the introduction of mortgagee interest insurance clauses put forward several suggestions.
