海上承運(yùn)人損害賠償責(zé)任研究

【摘要】:海上運(yùn)輸其本身就是一種風(fēng)險(xiǎn)性事業(yè),不是所有運(yùn)輸都可以完全順利達(dá)到,難免會(huì)產(chǎn)生與海上運(yùn)輸相關(guān)的法律糾紛,所以非常需要對(duì)海上運(yùn)輸相關(guān)法制的正確理解。本文將從中國《海商法》的角度考察與承運(yùn)人責(zé)任相關(guān)的責(zé)任主體、責(zé)任期間、責(zé)任原則的規(guī)定,并研究它們所存在的法律問題。論文共由五章構(gòu)成。 第一章是關(guān)于海上承運(yùn)人損害賠償責(zé)任的一般理論,在深入分析有關(guān)海上承運(yùn)人損害賠償責(zé)任意義的基礎(chǔ)上比較各國的立法例和國際公約。 第二章是關(guān)于海上貨物損害賠償?shù)呢?zé)任主體。主要分析有關(guān)契約承運(yùn)人與實(shí)際承運(yùn)人的內(nèi)容,其內(nèi)容也包括契約承運(yùn)人與實(shí)際承運(yùn)人之間的具體法律關(guān)系。 第三章是關(guān)于海上承運(yùn)人損害賠償責(zé)任期間的內(nèi)容,在分析中國《海商法》關(guān)于責(zé)任期間的規(guī)定之后比較考查有關(guān)責(zé)任期間的立法例。第四章是關(guān)于海上承運(yùn)人損害賠償責(zé)任原則的內(nèi)容。仔細(xì)考察責(zé)任原則的規(guī)定后研究承運(yùn)人的責(zé)任原則的性質(zhì)、責(zé)任原則的體系以及舉證責(zé)任的問題。 第五章是全文的結(jié)論部分。在整理本文所談到的內(nèi)容后提出立法的改善方案。 海上承運(yùn)人的損害賠償責(zé)任制度可以說是《海商法》的核心問題。本文最重要的目的是探索海上承運(yùn)人責(zé)任法律制度內(nèi)潛在的一些法律問題的解決辦法以及希望對(duì)中國《海商法》修正的完善提供一些建議。
[Abstract]:Maritime transport itself is a risky undertaking, not all transport can be completely achieved smoothly, it is inevitable that there will be legal disputes related to maritime transport, so it is very necessary to understand the relevant legal system of maritime transport. From the point of view of China's Maritime Law, this paper will examine the provisions of the liability principles related to the carrier's liability, the period of liability and the principles of liability, and study their legal problems. The thesis consists of five chapters. The first chapter is about the general theory of the liability of maritime carriers for damages. On the basis of in-depth analysis of the significance of the liability of maritime carriers for damages, the legislative cases and international conventions of various countries are compared. The second chapter is about the main body of liability for damage to goods at sea. This paper mainly analyzes the contents of the contract carrier and the actual carrier, including the specific legal relationship between the contract carrier and the actual carrier. The third chapter is about the period of maritime carrier's liability for damages. After analyzing the provisions of China's Maritime Law on the period of liability, it makes a comparative study of the legislative examples of the period of liability. The fourth chapter is about the content of the principle of liability for damages of the marine carrier. The nature of the liability principle, the system of the liability principle and the burden of proof are studied after careful examination of the provisions of the liability principle. The fifth chapter is the conclusion of the full text. After sorting out the contents of this article, the author puts forward the improvement plan of legislation. The liability system of maritime carrier is the core of Maritime Law. The most important purpose of this paper is to explore the solutions to some potential legal problems in the legal system of maritime carrier liability and to provide some suggestions for the perfection of the amendment of China's Maritime Law.
