【摘要】： 本文的寫作目的是為了研究實踐中出現(xiàn)的不同類型的轉(zhuǎn)船運輸?shù)暮戏ㄐ詥栴}，，以及承運人相應的權利義務和應承擔的責任。本文采用的是大陸法系的法學理論與英美法系的判例相結合的研究方法。 文章以轉(zhuǎn)船運輸?shù)母拍顬榛A，從民商法的基礎理論和各國海上貨物運輸法的規(guī)定及判例出發(fā)，結合不同原因下產(chǎn)生的轉(zhuǎn)船運輸?shù)男再|(zhì)，分析了轉(zhuǎn)船運輸?shù)暮戏ㄐ詥栴}，概括了承運人在合法的轉(zhuǎn)船運輸中享有的權利義務和非法轉(zhuǎn)船中的責任承擔問題。 本文并不局限于羅列材料，而是力求通過對各國立法的比較研究，完善我國《海商法》的相關規(guī)定；通過對案例的分析，解決現(xiàn)實的法律問題。文章最后總結了我國現(xiàn)行立法中存在的缺憾與不足，并對完善我國《海商法》中的有關規(guī)定提出了自己的建議。
[Abstract]:The purpose of this paper is to study the legality of different transshipment transportation in practice and the carrier's corresponding rights and obligations. This paper adopts the research method of combining the legal theory of the continental law system with the jurisprudence of the common law system. Based on the concept of transshipment, this paper, based on the basic theory of civil and commercial law and the regulations and precedents of various countries' maritime freight transport law, analyzes the legality of transshipment transportation according to the nature of transshipment transportation under different reasons. The rights and obligations of the carrier in the legal transshipment and the liability in the illegal transshipment are summarized. This paper is not limited to listing materials, but tries to perfect the relevant provisions of Maritime Law through the comparative study of the legislation of various countries, and to solve the practical legal problems through the analysis of cases. In the end, the article summarizes the shortcomings and shortcomings in the current legislation of our country, and puts forward some suggestions for perfecting the relevant regulations in Maritime Law of our country.
