淺議商法在現(xiàn)代的基本原則

【摘要】：商法在現(xiàn)代的基本原則,集中體現(xiàn)出商事立法的價值追求和宗旨,為傳統(tǒng)商法的實踐經(jīng)驗,以及現(xiàn)代商法總體發(fā)展趨勢之下的法律反映。總體而言,可將其歸納為互惠性原則和營利性原則。本次研究旨在對商法的完善有所啟示。
[Abstract]:The commercial law embodies the value pursuit and purpose of commercial legislation in the modern basic principle, which is the practice experience of the traditional commercial law and the legal reflection under the general development trend of the modern commercial law. In general, it can be summarized as the principle of reciprocity and the principle of profitability. The purpose of this study is to enlighten the perfection of commercial law.
