論我國(guó)海事行政救濟(jì)存在的問題及完善

【摘要】:海事行政救濟(jì)是指公民、法人以及其他組織因權(quán)利(甚至公益)受到海事行政管理機(jī)關(guān)瑕疵行政行為之侵害時(shí),對(duì)于受侵害的主體依法給予行政體系內(nèi)及行政體系外(主要是司法體系)之保護(hù)措施,屬于善后性質(zhì)的消極作為,即無侵害無救濟(jì),海事行政救濟(jì)因相對(duì)人事后提起,具有補(bǔ)救性。同時(shí),海事行政救濟(jì)關(guān)乎實(shí)體性規(guī)范和程序性規(guī)范的實(shí)現(xiàn),其應(yīng)該以保護(hù)相對(duì)人的合法權(quán)益為最主要目的。在我國(guó),海事行政復(fù)議以及海事行政訴訟是海事權(quán)利救濟(jì)的兩種最主要的方法與途徑。近年來,國(guó)外學(xué)者圍繞海事行政法這一主題,產(chǎn)生的研究成果不少,但國(guó)內(nèi)研究始終并不顯得火熱,特別是權(quán)利救濟(jì)方面有許多問題值得系統(tǒng)研究。 本文集中闡述了海事行政法以及海事行政救濟(jì)的相關(guān)概念及內(nèi)涵,圍繞我國(guó)海事行政權(quán)利人在尋求權(quán)利救濟(jì)的過程中可能遇到的一些問題,著重對(duì)海事行政復(fù)議以及海事行政訴訟中存在的問題做了相應(yīng)的分析,剖析了海事行政復(fù)議的范圍、復(fù)議機(jī)構(gòu)的獨(dú)立性以及復(fù)議調(diào)解制度的適用,討論了海事行政訴訟的管轄權(quán),就海事行政訴訟中船舶的主體資格提出了個(gè)人的看法,并對(duì)海事行政復(fù)議與訴訟的銜接進(jìn)行了一定的思考。 本文系運(yùn)用實(shí)證分析以及案例分析的方法進(jìn)行的專題研究。全文分3個(gè)部分:第一部分,旨在介紹海事行政法和海事行政救濟(jì)的基本理論,這是指導(dǎo)本文寫作的理論基礎(chǔ),第二部分,主要研究我國(guó)海事行政救濟(jì)存在的問題,本文的著重點(diǎn)在探討海事行政復(fù)議和海事行政訴訟存在的缺陷,第三部分,分別從法學(xué)基本理論、現(xiàn)有法律以及當(dāng)前實(shí)踐等多個(gè)角度對(duì)存在的問題進(jìn)行了逐步分析,進(jìn)而提出了一定的完善我國(guó)海事行政救濟(jì)的意見。 本文主要?jiǎng)?chuàng)新體現(xiàn)在把海商法中對(duì)物訴訟的理論引入海事行政法學(xué)。對(duì)物訴訟原本是英美海商法中的最富有魅力的理論之一,因國(guó)際貨物與貿(mào)易蓬勃發(fā)展,國(guó)際法發(fā)展迅速,漸漸地該理論為很多國(guó)家海商法所接受。我國(guó)海商法吸收了該理論的優(yōu)秀成果。
[Abstract]:Maritime administrative relief refers to citizens, legal persons and other organizations whose rights (or even public welfare) are infringed upon by the defective administrative acts of maritime administrative organs, The protection measures given by the subject to the administrative system and outside the administrative system (mainly the judicial system) according to law are negative acts of the nature of rehabilitation, that is, no infringement and no relief, and the maritime administrative relief is brought afterwards by the counterpart, It is remedial. At the same time, maritime administrative relief is related to the realization of substantive and procedural norms, and its main purpose should be to protect the legitimate rights and interests of the counterpart. In China, maritime administrative reconsideration and maritime administrative litigation are the two most important ways and means to remedy maritime rights. In recent years, foreign scholars around the theme of maritime administrative law, produced a lot of research results, but the domestic research is not always hot, especially in the right relief aspect there are many problems worthy of systematic study. This paper focuses on the related concepts and connotations of maritime administrative law and maritime administrative relief, and focuses on some problems that may be encountered in the process of seeking right relief for maritime administrative right holders in our country. The paper emphatically analyzes the problems existing in maritime administrative reconsideration and maritime administrative litigation, analyzes the scope of maritime administrative reconsideration, the independence of reconsideration organization and the application of reconsideration mediation system. This paper discusses the jurisdiction of maritime administrative litigation, puts forward personal views on the subject qualification of ships in maritime administrative litigation, and gives some thoughts on the connection between maritime administrative reconsideration and litigation. This paper is a case study using empirical analysis and case analysis. The thesis is divided into three parts: the first part is to introduce the basic theory of maritime administrative law and maritime administrative relief, which is the theoretical basis to guide the writing of this paper, the second part is mainly to study the existing problems of maritime administrative relief in China. This paper focuses on discussing the defects of maritime administrative reconsideration and maritime administrative litigation. In the third part, the existing problems are analyzed step by step from the basic theory of law, existing law and current practice, etc. Furthermore, the author puts forward some suggestions on how to improve the maritime administrative relief in our country. The main innovation of this paper is to introduce the theory of action in rem into maritime administrative law. Action in rem was originally one of the most attractive theories in British and American maritime law. Due to the booming development of international goods and trade, international law developed rapidly, and gradually this theory was accepted by many countries' maritime law. China's maritime law absorbs the outstanding achievements of the theory.
